Smith County District Attorney Matt Bingham told the Tyler Morning Telegraph he submitted the paperwork to Judge Ellis Friday because the alleged victim in the case lied repeatedly to a grand jury during questioning in the grand jury's inquiry into an alleged assault by Shelton on May 14. Bingham said the complainant, Jessica Johnson, lied under oath several times when he asked her about an extramarital affair with a Whitehouse police officer.
