Floyd, Jr. ruled this week during a mental competency hearing that Marques Brown, who is charged with first degree murder in the 2012 death of a Lumberton police officer , will not face the death penalty, according to court officials. Britt told ABC 15 News last August at least three of Brown's court appointed attorneys have withdrew from the case for different reasons, making it difficult to set a trial date.
