That possibility emerged last week after Lubbock Mayor Dan Pope and LP&L Director David McCalla submitted testimony to the Public Utility Commission of Texas in the case for Lubbock to join the Electric Reliability Council of Texas, saying it's their hope Lubbock opts in to the competitive retail market.

Casey Baker, who was indicted Tuesday, is charged with a second-degree felony count of intoxication manslaughter, which carries a punishment of two to 20 years in prison.

A police officer on the scene was able to confirm that a white four-door Kia sedan with four people in the vehicle ordered food from the Sonic. The customers tried to pay for the food with a stolen credit card and after the card would not work they attempted to drive off without paying.

The victim gave the robbers an undisclosed amount of money before the robbers fled south from the scene on foot.
