    The Ohio Supreme Court on Tuesday overturned a decision against an Akron hospital, holding an appeals court erred when it ruled parents who sued for malpractice after their child died deserved a second trial. In a 6-1 ruling , the court found that while the trial jury that heard the case was given an unnecessary jury instruction, that instruction was not prejudicial and not cause for an appellate court to grant the plaintiffs a new trial.
