Paterson Pushes For September Vote On Same-Sex Marriage

Governor David Paterson will push the State Senate to vote on same-sex marriage during a special session in early September. A spokesman for the governor said on Friday that the State Senate is currently not in the right mindset to take up the issue. The governor said he believes that marriage equality is an important civil rights issue and he will work with Senate leaders to move the process forward in the fall.

Better late then never.

As more states legalize Equal Marriage Rights for gay couples, a tipping point is going to be reached. And in the near future, SCOTUS is going to have to rule on whether DOMA is constitutional. I believe SCOTUS will declare it unconstitutional.

SCOTUS will not have to rule on DOMA, because it is more likely that Congress will repeal it than a suit will get to SCOTUS.

Even if we have a suit, the current court is not going to overrule. It is controlled by conservative activist judges, who let their own opinions override the constitution. The RATS (Roberts, Alito, Thomas, Scalia) will never vote to overturn DOMA. That means you have to convince all 5 of the other justices, and it's not clear that they would.
