Ex-Gitmo prosecutor alleges politics

“The guy who said waterboarding is A-OK I was not going to take orders from. I quit”

A former chief prosecutor at Guantanamo Bay testified Monday that he faced growing interference from his Pentagon superiors following the arrival at the Navy base of 'high-value' detainees with direct links to the Sept. 11 attacks.

Air Force Col. Morris Davis, who was called to testify by lawyers for Osama bin Laden's former driver, said Pentagon officials showed increased interest in the schedule and the selection of detainees for trial once the prisoners arrived from secret CIA custody in September 2006. Read more

Gitmo Trials Face New Obstacle

“If they had an opportunity for a fair and open trial, they would take it.”

The U.S. war crimes trials at Guantanamo Bay are running into a new obstacle which throws their credibility into doubt: boycotts by the defendants.

Three alleged al Qaeda operatives have now chosen to boycott their upcoming trials and more are expected to do the same as the military attempts to prosecute dozens of Guantanamo prisoners at this isolated, high-security U.S. base overlooking the Caribbean.

Two men, a Saudi and a Yemeni, at pretrial hearings this week denounced the tribunals as a sham and said they would not cooperate with their defense or appear for future hearings. Read more

Chinese Muslim Challenges Combatant Tag

“This is a head-on challenge to the so-called 'enemy combatant”

Huzaifa Parhat has been imprisoned at Guantanamo Bay for nearly six years. Yet, he never took up arms against the United States and there's no evidence he planned a terrorist attack. In fact, his lawyers say he considers the U.S. an ideological ally.

Parhat is one of several Muslims from western China known as Uighurs who were swept up by U.S. forces as suspected terrorists. Now, after years of legal wrangling, Parhat is asking a federal appeals court to consider for the first time what it really means to be an enemy combatant. Read more
