Can we afford to lock up alleged "Gang Members" with no r...

And believe me criminals who want to make a career outta crime and continue to go to HELL a.k.a Prison they will show a pattern that they want to be there! Why give people extra time while we pick up the tab? I think rather than waste money on this extreme ridiculous law, give guys a option to serve in our milatary and prove themselves for the term of a normal reduced sentences. That will be better than overcrowded prison in broke states!  (Sep 30, 2009 | post #4)

And continue to waste money? you might as well put a gate around california then and let China continue to loan us money! I would rather turn these guys into productive members of society if you ask me. I was once a gang member and now i'm a tax paying citizen with 5 kids. If this B.S. law was out when I was growing up they would of lock me up and threw away the key. I think it's a huge waste of money and is really curbing nothing, but California itself. This law has been around for 9yrs and they selectivly use it, and constantly breaks Constitutional Rights!I know several former and active gangmembers in California that went to jail did their time, got out, and pay taxes. If this law would have been around they would have never been given that chance.  (Sep 29, 2009 | post #3)

Well thats just one of the ways the California Penal Systems is wasting billions of tax payers money. Article 186.22.a,b of the California Penal Code allows authority to lock-up, and tact on extra time anywhere from 1-25yrs to life basically anyone kids too involved in or even suspected of being a gang member. What happen to do your time for the crime you commit? This is one reason voter should really pay attention to injuctions and get your community really involved, cause the ones this injuction was suppose to help it so far has done nothing. All this has done was lock up people for extra time and using tax payers money instead of helping them become productive members of society!! -Bang SO-CALLED GANG MEMBERS BETTER TAKE A SECOND THOUGHT ON GANGBANGING BECAUSE NOW "IF YOU DO A CRIME, THEY GIVING YOU EXTRA TIME" Please Read:Following is the ridiculous CA Penal Code 186.22 (a) Any person who actively participates in any criminal street gang with knowledge that its members engage in or have engaged in a pattern of criminal gang activity, and who willfully promotes, furthers, or assists in any felonious criminal conduct by members of that gang, shall be punished by imprisonment in a county jail for a period not to exceed one year, or by imprisonment in the state prison for 16 months, or two or three years. (b) (1) Except as provided in paragraphs (4) and (5), any person who is convicted of a felony committed for the benefit of, at the direction of, or in association with any criminal street gang, with the specific intent to promote, further, or assist in any criminal conduct by gang members, shall, upon conviction of that felony, in addition and consecutive to the punishment prescribed for the felony or attempted felony of which he or she has been convicted, be punished as follows: (A) Except as provided in subparagraphs (B) and (C), the person shall be punished by an additional term of two, three, or four years at the court's discretion. (B) If the felony is a serious felony, as defined in subdivision (c) of Section 1192.7, the person shall be punished by an additional term of five years. (C) If the felony is a violent felony, as defined in subdivision (c) of Section 667.5, the person shall be punished by an additional term of 10 years. (2) If the underlying felony described in paragraph (1) is committed on the grounds of, or within 1,000 feet of, a public or private elementary, vocational, junior high, or high school, during hours in which the facility is open for classes or school-related programs or when minors are using the facility, that fact shall be a circumstance in aggravation of the crime in imposing a term under paragraph (1). (3) The court shall order the imposition of the middle term of the sentence enhancement, unless there are circumstances in aggravation or mitigation. The court shall state the reasons for its choice of sentencing enhancements on the record at the time of the sentencing. (4) Any person who is convicted of a felony enumerated in this paragraph committed for the benefit of, at the direction of, or in association with any criminal street gang, with the specific intent to promote, further, or assist in any criminal conduct by gang members, shall, upon conviction of that felony, be sentenced to an indeterminate term of life imprisonment with a minimum term of the indeterminate sentence calculated as the greater of:  (Sep 29, 2009 | post #1)
