Yep. If the "facts" support you, go with the judge. If the "emotions " support you, go with the jury. If neither supports you, you're probably screwed either way.  (16 hrs ago | post #255)

The constitution does not "allow" you to do anything. It is a limitation on government. What they're "allowed " (or not allowed) to do.  (16 hrs ago | post #254)

You can bemoan you odds of successful challenge all you want, but unless you actually MAKE IT to court, you'll never have the opportunity to TRY to challenge it. And your best chance of making it alive to court is to not resist arrest.  (16 hrs ago | post #253)

Better be careful. Some jurisdictions have declared that even the rainwater that falls on your own property isn't yours.  (16 hrs ago | post #200)

Actually, I don't think there's any evidence that he cared what race the slaves were.  (16 hrs ago | post #199)

They should only be "deemed" in court, individually. Not because you have a payee for your disability or social security check. Maybe they can't get out of the house and it's easier for someone else to do it for them. Maybe they're bad at math. Doesn't mean they're a danger to themselves or others, or that they cannot treat a gun properly. States already have a process to deem someone unfit or dangerous. It's a judicial process. A federal "deeming " is unnecessary and unwanted. Exactly how many Social Security recipients with payees have misused a firearm anyway?  (17 hrs ago | post #198)

If they're upheld, they're not "unconstituti onal" by the only measure that matters.  (Yesterday | post #244)

It probably depends more on the emotional issues. (Despite being told not to) Juries take them into account. Judges don't.  (Yesterday | post #243)

There are all levels of mental illness, from the mild to the debilitating to the dangerous. Not everyone who seeks mental health services is a danger to themselves or others. Denying a right such as the right to bear arms should be done on an individual basis by adjudication. Not by blanket fiat.  (Yesterday | post #157)

Judges interpret the law. That's their job. Always go for a jury trial. They could determine that the law does not apply in your particular case. Oh, and try to make sure you make it to your trial alive... your best odds will be had by not resisting arrest.  (Monday | post #215)

Do you think the law against robbing a liquor store is unconstitutional? The one against brandishing a firearm? What specifically are you talking about? Do you mean "held up" as in delayed? Or do you mean upheld?  (Monday | post #214)

No they didn't, they INTRODUCED a BILL giving people who INADVERTENTLY hit protesters in the road immunity from lawsuits. The bill FAILED by a 51-40 vote. http://www.reuters .com/article/us-no rth-dakota-bill-id USKBN15T2D5 That's what you get for reading the headlines instead of the articles, and then quit reading anything once you've found something you want to hear.  (Sunday Feb 19 | post #208)

What does that mean, arbitrary law? The laws are on the books, after they were legislated by people you elected for the purpose of doing so. I'll bet you wouldn't think they were so arbitrary if they were perpetrated against you.  (Sunday Feb 19 | post #207)

They're like chickens whose heads have been chopped off, running around the barnyard not yet realizing that they are dead.  (Sunday Feb 19 | post #92)

Russia (or the Soviet Union) has been testing our limits for the last 50 years that I know of. There have been numerous encounters and close calls (plane to ship, ship to ship, plane to plane), them spying on us, us spying on them, etc. This has little to do with Trump or Putin. There are things going on that transcend the presidency, of both countries. And then you have China, who isn't much different, though less in the news. They spy on us, and we, them too. Hell, there is even spying going on between so-called allies (England, France, Israel)! It's part of the world we live in.  (Sunday Feb 19 | post #91)
