How did Matthew Flack die a 'HERO'

Only thing i can really find is, After hearing testimony Thursday, a Mercer County magistrate sent the case of a Virginia man facing a charge of first-degree murder to the Mercer County Grand Jury. Brandon Flack, 20, of Pulaski, Va. was arrested Jan. 29 with two other people after the death of his cousin, 17-year-old Matthew Flack of 119 Magnolia Street in Bluefield. Lt. Scott Myers of the Bluefield Police Depart-ment testified that he received two calls Jan. 29 concerning gunshot victims. The first was at Magnolia Street, and the second was reported at Bluefield Regional Medical Center. Myers said when he arrived at Magnolia Street, medical personnel told him that Matthew Flack had shot in the face. A coroner later told him that the bullet came out the lower jaw and into the chest. The officer at the scene, Patrolman R.S. Gibson, had secured a 9 mm pistol found on the home’s stairs near Matthew Flack’s body; a spent shell casing was lodged in it, Myers said. A second shell casing was also found on the stairs. Matthew Flack was playing video games with friends and relatives when he heard a knock at the back door, Myers said, adding that witnesses said Flack saw three individuals with their backs turned when he went to check. Flack then came back, told the people present that there may be trouble, and left to get his father’s gun. A friend followed him upstairs. Three male individuals then broke in, Myers said. All of them were wearing dark clothing and hoodie jackets. Two of them were wearing black ski masks and one was wearing a red ski mask. Witnesses said one of the intruders, allegedly Brandon Flack, went upstairs and a shot, followed by the cry of “I’ve been shot! I’ve been shot” was heard. Then a second person, allegedly Jasmen Montgomery, 21, went upstairs and a second shot was heard, Myers said. Matthew Flack’s friend had gone into the bathroom; he later left through a window. Myers said this witness said he heard shots, but did not see them fired. The third intruder stayed downstairs. Myers said one bullet was recovered from the victim. A second slug that had passed through the bathroom door was also found. At Bluefield Regional Medical Center, Brandon Flack told Bluefield officers how he had been shot, but his story was inconsistent, Myers said. Two individuals who dropped him off at BRMC, Montgomery and a 17-year-old male, also gave inconsistent stories. After the woman who had been driving their car allowed officers to look in its trunk, a search warrant was obtained. Red and black ski masks, a 9mm handgun, and a .38 Derringer pistol were found, Myers said. Both of the casings found on the stairs were 9 mm bullets. Brandon Flack had injuries to a wrist and leg; a bullet passing through the wrist may have inflicted both injuries, Myers said. Attorney Derrick Lefler, who was representing Brandon Flack along with attorney Paul Cassell, said there was no indication that his client had discharged a weapon or caused a death. He asked that the charge be dismissed. Magistrate Flanigan ruled there was probable cause in Brandon Flack’s case and forwarded it to the June session of the Mercer County Grand Jury. He is being held without bond at the Southern Regional Jail (SRJ). Montgomery is also incarcerated at SRJ without bond, and the juvenile is being held without bond at the Sam Perdue Juvenile Center near Princeton.
