We IS's are hoping the same thing. All been waiting the same length of time... and the IS's have been like the red headed step children. Few have heard a word from their attorney's. We initially were turned down completly, a little over a month ago, but were advised to appeal. That should be over with quickly... at least I hope so.  (Nov 1, 2009 | post #6383)

I'm so glad that so many MIs are being settled and that you are getting your money. Maybe now they can take care of the IS cases...we have all been waiting for years, and all have been harmed... no matter what the actual injury. IS cases have been treated like red haired step children... many have little if any information at all. And no, justice has not been done here... they have paid a pitance to insure our silence... that is all, and are still making money on the backs of their victims.  (Oct 18, 2009 | post #5785)

The entire situation with some of these attorneys is horrible. Our attorney, who we spoke with two weeks ago, has been pretty good. When were talking about being turned down on both parts of our case, and the paralegal suggested appealing on one of the parts, the attorney, said, "NO" appeal both... we have nothing to lose. Sure, he wants some of the money, but if I don't get paid, neither does he. As far as "what" they get paid, I know this is an issue for many, and the % seems unfair, but it is very normal and usual for them to take 40% of a win in other cases. So much anxiety over this horrible thing. I read all the comments daily, and just know that every victim has been totally abused over this issue. Maybe once all of the MIs are taken care of (so to speak), they can finally take some action on the IS cases... Keep in mind that there are some who get pensions (ex. Federal Retiress), who are not eligible for SSD, but once they turn 65 become eligible for Medicare. Not everyone is covered by Social Security.  (Sep 7, 2009 | post #4752)

Many people have insurance... I pay $359 monthly... I have a $20 copay for office visits... I pay 20% of the wholesale cost of my meds... any where from $.76 to over $200 a month per Rx... and have 8 meds to pay for. And each procedure and lab has a copay, plus amts that ins will not cover. We all do what we have to do. No one deserves the treatment that Merck has heaped on us all. There is no amount possible to pay for a life lost or a life wasted due to the negligence of this drug company.  (Sep 5, 2009 | post #4734)

Finally spoke with the attorney this afternoon. They files for two separate events for us (this is for my dad, who passed away in 2002). Anyway, on the first one there was some discrepancy as to whether it was a TIA is IS... and we all know that TIAs are not covered under this settlement. The Second event was when he died from what the attending doctors said was a stoke (IS)... but there was no discharge summary because he passed away at home. Apparently the claims administrator told the atty to definitely appeal the second one. But in talking to the attorney today, he is appealing BOTH. He thinks we may have a good chance. The atty also told us that the appeals can anywhere from 2 days to two months... so the wait is on once again.  (Sep 4, 2009 | post #4712)

Finally got "the" call from attorney's office today. Of course, this was the first afternoon when NO ONE was at home, and they left a message. When I called back, after 5pm, the lady we have to talk with had just pulled out of the parking lot... we were told to call back in the morning between 8 and 8:30... I sure hope it is good news. For all who don't know, ours is an IS claim... so they are making decisions on IS claims already. We are excited, but a little afraid of what we will learn.
