Mandatory Changes In Asthma Inhalers Take Effect Jan. 1

Arel, too many reasons, mainly: 1) $$$. You want to try to out-lawyer the U.S. Govt., which can print its own money? 2) Time. Years and years, appeals etc., etc. What makes you so sure we'll win a lawsuit against the EPA? 3) I'm not a lawyer, but I think only the Supreme Court can overturn/amend an Act of Congress (the Clean Air Act is what we must amend politically by a vote of Congress to legalize CFC inhalers.) 4. What assurance do we have that after spending hundreds of thousands of dollars and many, many years of appeals that the U.S. Supreme Court would overturn/amend the Clean Air Act- I have no reason to believe that the Clean Air Act is unconstitutional. 5. Complexity. Our problem is complex, our solution requires White House and Congressional action- a Circuit Court judge can't make this happen for us in our lifetimes- too many moving parts. 6. Bottom line- this is a POLITICAL problem that requires a POLITICAL solution. A lawsuit against the EPA and fifty cents will get you a cup of coffee, as they say. And winning a class action lawsuit against a drug company would be great- for the plaintiff attorneys- but it does nothing to bring back CFC MDIs. WE ALL MUST CALL our two US Senators and US Rep AND Obama and McCain. The US Clean Air Act must be amended to legalize CFC metered-dose inhalers. (FDA Final Rule 21 CFR 2.125 must be repealed as well, but that's easy once the Clean Air Act is amended- which is an extremely ambitious goal requiring the phone calls, emails, and faxes of many of our 40 million pulmonary patients and their friends and families.) This will, by the way, require the US to unilaterally abrogate the provision of the Montreal Protocol (an international treaty the US initiated under Reagan- and the US pushed hard for this CFC MDI ban stupidity) to 'save the ozone layer'- epic irrationality based on staggering amounts of junk science). Please follow our simple suggestions at the bottom of the Homepage of our website at savecfcinhalers.or g (also check the website page titled 'Make Six Phone Calls'. The sixth call is to President Bush- we need him to order two FDA bureaucrat-MDs, John Jenkins and Robert Meyer, who supervised the scam, sweetheart 'regulation' of HFA MDIs at the FDA for the last 12 years, to RELEASE the vital U.S. postmarketing data on Proventil HFA and Ventolin HFA that they are afraid to release- all is or will be explained on the website. We strongly believe that this data will show that the 12/31/08 ban of CFC albuterol is ILLEGAL because, in our opinion, it will clearly demonstrate that the FDA's ban violates their own requirements under FDA 21 CFR 2.125  (Oct 18, 2008 | post #5)

Possible Shortage of Albuterol Inhalers

Lee, you're right- it's time to fight back, and we only need a small percentage of the 40 million patients who use CFC MDIs to call their five political targets (as described at the bottom of the homepage of our new website- see link below) to change this. When you consider that each of these 40 million patients has friends/family who are willing to call THEIR five political targets as well, not to mention other voters (including many REAL environmentalists, as opposed to the National Resource Defense Council radicals, for example) who HATE the arrogance and stupidity and junk science that motivated this ban, it's easy to see how we CAN achieve our political goal of permanently legalizing all CFC MDIs over the next year or two by amending the Clean Air Act and abolishing FDA Final Rule 21 CFR 2.125 in its entirety. There ARE manufacturers ready, willing and able to make CFC-11,12 and carbon tetrachloride; there ARE components manufacturers willing to produce these products; there ARE top-quality, experienced MDI generic drug companies willing to make generic CFC MDIs. ANYONE who says otherwise is LYING. And we have the increasing support of patients all over the world- ANYONE who says that HFA MDIs are as well tolerated as CFC MDIs in other countries where they have been introduced is LYING. Having said that, Jack50 raises an excellent point- in fact, there are THREE ARGUMENTS ALL OF US MUST STOP MAKING IMMEDIATELY- we MUST learn them and NEVER repeat them- we MUST learn these THREE BASIC FACTS if we want to win this political fight. They are at the top of the ACTIONABLE INFORMATION page of our new (unfinished, be patient a little longer) website at saveCFCinhalers.or g REGARDLESS of whether or not you've signed the petition, you need to sign up at the bottom of the homepage of saveCFCinhaletrs.o rg if you want to be kept updated by email as we begin our campaign and our press releases shortly. By the way, we've received our first supply of generic CFC albuterol inhalers (about $4 each- that's no typo), they're made by GlaxoSmithKline, they're called 'Ventorlin' (don't ask me why) and they are very good, with expiration dates of May 2010. Use the link for on the bottom of the ACTIONABLE INFORMATION page of our website saveCFCinhalers.or g and order a few to see if you like them- it takes about two weeks to get your order delivered. If you like them, remember that the clock on the CFC MDI ban is counting down to 12/31/08- a little over two months- and it could take us two years to reverse this CFC ban, maybe longer, and obviously, it's possible that enough people will NOT call their five political targets as we've requested on our website (as they have NOT followed our repeated requests to file MedWatch complaints against HFA MDIs they've had problems with) in which case we will NOT be able to save CFC MDIs. You can lead a horse to water... Therefore, I suggest you QUICKLY get a test order in to and if you like it, stock up for the long haul while you can. (And just as with Gillespie's and every other vendor we recommend, we are NOT compensated in any way for these referrals.) saveCFCinhalers.or g Sign up above even if you've already signed our petition at: http://www.ipetiti aveCFCinhalers/ and file your MedWatch reports online on either site above!!!!! AND READ AND LEARN THE THREE ARGUMENTS WE MUST NEVER MAKE AGAIN AT THE TOP OF THE 'ACTIONABLE INFORMATION' PAGE AT SAVECFCINHALERS.OR G It's time to learn these THREE BASIC FACTS if we want to win this fight.  (Oct 14, 2008 | post #176)

Sign the petition and stay tuned for our first in a series of press releases starting this month that will expose this unprecedented medical scandal- we will fight to amend the US Clean Air Act and abolish FDA Final Rule 21 CFR 2.125 in order to permanently legalize CFC metered-dose inhalers: http://www.ipetiti aveCFCinhalers/ Millions of pulmonary patients will shove this CFC inhaler ban down the throats of the FDA, the EPA, the American Lung Association, the Asthma and Allergy Network Mothers of Asthmatics, the Asthma and Allergy Foundation of America, and any MDs who are too stupid to stay the hell out of our way, and make them choke on it. The festivities will begin on or about 1/1/09, when the CFC albuterol ban takes effect, and everyone finally learns about it.  (Oct 9, 2008 | post #599)

New Asthma Inhaler Will Cost More

Good for you, Stan, you are one of the fortunate majority who only have to worry about COST. Believe it or not, there are many thousands of patients who WISH they had your problem. For them, HFA inhalers are NOT as safe and effective as CFC inhalers, due to the HFA-134a propellant which was NEVER tested on patients, only on normal, healthy subjects; the ethanol, which is a PROVEN BRONCHOCONSTRICTOR for some patients in the amounts used in MDIs; the corn residue in the ethanol- a separate risk for many corn-sensitive asthmatics; the potentially very dangerous, poorly understood MDI impurities known as 'extractables' and 'leachables'- byproducts of the interaction between the propellant, the elastomers (complex, proprietary rubber valve seals) and all of the other hi-tech materials- such as those used in Ventolin's proprietary technology that allows it to avoid the use of chemical solvents like ethanol. I really don't mean to criticize you personally, Stan, but to say that the only difference between an HFA rescue MDI and a CFC rescue MDI is the way it's being administered (meaning the propellant alone is different- as if the propellant in and of itself is harmless to all) is not only false, but it is like saying that the only difference between having a relaxing massage and gently strangled to death is the way the massage is administered. It's still just a massage.  (Sep 23, 2008 | post #70)

Nelly, the syndrome you are complaining about is linked to HFA albuterol- although I doubt that the albuterol sulfate is the problem- get some Warrick CFC albuterol from Gillespie's- I don't remember seeing the syndrome you described being associated with CFC inhalers. You can get Warrick from Gillespie's drug store- phone # is on the upper right corner of the petition: http://www.ipetiti aveCFCinhalers/ Good Luck P.S. Email me at [email protected] for a less expensive CFC alternative.  (Sep 14, 2008 | post #586)
