Lee, Please quote for me the NCGS that gives "Managers " law enforcement authority. Does H259 in anyway abate the penalty if the smoking patron is smoking in defiance of the owner's wishes? No. If the owner called the police to remove an unruly smoking patron, is the penalty waived or reduced under H259? No. Face it - it is a poorly written bill. You oppose smoking in public places - fine. However, passing another poorly written law ripe with the potential for unintended consequences is just bad government.  (Jan 1, 2008 | post #12)

It doesn't make much sense to give the rental car company a fine if you get caught speeding in their car.... does it? That's essentially the flawed logic behind H259. The bill provides penalties on the business owner / property owner for the behavior of others. Should the City of Asheville be fined if rebellious Civic Center patrons light up a cigarette in the back? This bill is yet another example of the crazy process by which we make laws. I offered to amend the bill and made several suggestions to correct it, however, the primary sponsor would hear nothing of it. I feel certain that many members voter for this bill simply because they knew that some in the public would spin this bill into a pure referendum on smoking. TheBroker is correct. Snowbird is a designated MOA and has been for a long time. The Airport Authority doesn't have anything to do with actual operations in the air. I have no idea why the Asheville Airport Authority's spokesperson would comment on this.  (Dec 10, 2007 | post #32)
