I check this board every few days and every time I hope to read about the case moving forward. Each time I am disappointed. And yes, still angry! There are people who know more about what happened that day. Some are former law enforcement, some were news reporters, some were familiar with the Golubs, some were part of our court system - and several were THERE IN THE HOUSE THAT DAY. One of them is in jail. Would Robert ever speak up? It's been said that he has nothing to gain, but that is not true. Does he know that he can still do something substantially good with his life by simply telling the truth now? Meanwhile, all these supposedly 'lab abiding' people who have information stay quiet about what they know because they don't want to get involved. We don't seem to be able to get the attention of the Nassau County Justice System. I have so wished for publicity -- tons of it, and preferably national attention because the people who run Nassau County figure we'll all just give up. Not going to happen. The videos posted by The Last Boy Scout on YouTube are extremely interesting. Particularly the one which contrasts 2 different questioning sessions of Steven Bataan, one of the boys in the house during the murder. During the trial, he tells one story about the length of time JJ was away from him and the other boy who was there -- and when he is questioned years later, he admits that JJ was gone for a much longer period of time. So why the discrepancy? I wonder if his testimony might have been coached the first time (when he was just a kid who must have been VERY scared about possible consequences)? And if so, were there any other facts affecting the timeline that may also have been kept from the jury? Why did Bataan change his story years later during what appears to be some kind of a lie detector test? This video really should be looked at -- it's only a few minutes long and really demands that further questioning be done! So many questions and no answers. When will we see some forward momentum?? And why in the world did Kathleen Rice reopen this case anyway? Did she want 'brownie points' for appearing to be responsive to the Tinyes family? We were all so heartened by her taking that step -- and so hopeful about finally uncovering what went on behind closed doors in this case. I am referring to the crime of what happened behind the closed door of the Golub house -- and just as important, the crime of what went on behind the closed doors of the Nassau County DA's office, then and NOW. Why did Kathleen Rice even bother to make what now appears to be such a completely empty gesture? We are all beyond frustrated. We don't care where the chips fall. We want the truth about why JJ was allowed to walk away from what happened in his basement back in March of 1989. It's not going away. Not now and not ever. @KellysAngel - Thank you for posting that info. I would love to know more about that DNA evidence. It was so new at the time and I don't think that evidence was well understood. I have to believe that when the case was reopened, all of the available physical evidence would have been retested using modern DNA techniques. I also imagine that whatever they found may have indicated that others could have been involved in the clean up. That may already be past its statute of limitations. It would be very interesting to know more about exactly what was found in the basement after the Golubs moved out. If you can tell us without compromising things, please do. I'd imagine that if either of the other 2 boys' DNA was present at the murder scene, that would definitely be very important. There are supposedly several people JJ made statements to, indicating that he did indeed make the call to Kelly's house. I read on another board (the Yuku board) that JJ also admitted to opening the door to Kelly that day. If you are one of the people JJ spoke with about this, have you contacted the DA's office to tell them about these statements? I know it's asking a lot, but if that's all he did, you can certainly just tell the truth about what he told you. If I were one of those two other boys, and I knew anything that didn't come out at the trial, I'd sure want to try and make a deal about it NOW, before the time for making deals is gone forever. I hope they realize that any deals they may have made with Dillon's office way back then died with Dillon. Speak up folks -- the time is NOW. JUSTICE FOR KELLY  (May 15, 2011 | post #660)

I keep coming back to the evidence. Evidence in a murder case in generally preserved. Why hasn't the evidence been re-tested using new DNA methodologies? And Junior Sleuth, while I am still interested in your take on the Kelly Tinyes case, please don't believe that all the world, or even all Catholics, think that the Pope is the be-all and end-all authority for anything, especially Opus Dei. Just because he endorsed Opus Dei does NOT give it the "seal of approval" for the rest of us. We could introduce the subject of the horrific child molestation that was allowed to continue for years under all the Popes, but this isn't the time or the place. Opus Dei is an extremist organization. I am not a fan of any extremist organizations, and especially not of that one. I could point out a lot of what I feel are absolutely crazy, outlandish practices that former members have given testimony about, but I won't bother. The people of Nassau County elected Dillon to fight crime, not to indulge the beliefs of some extremist, secret society that he was a member of. And it's my opinion that he let all of us, his constituents down, and he completely let Kelly and her family down when it came to his handling of the Tinyes case. By the way, I was able to obtain some details about John J O'Grady. He was suspended for 5 years back in 1999 for not returning money to to a client. He claimed he had not received the funds (it was refunded bail money that he was supposed to have taken his fee from) and yet it was later proven that he had deposited those funds into his own account. Something interesting surfaced during my research - it seems that a lawyer named William McGoldrick, was involved in O'Grady's suspension. (You will remember that there was a William McGoldrick who was an attorney who was the Golubs' family lawyer when Robert & JJ were first questioned inside the Golub house. He is the one who stopped the questioning.) The client in this O'Grady case went to a lawyer named William McGoldrick in order to try and get O'Grady to return the bail money. When McGoldrick wasn't able to get O'Grady to return the money, they complained to higher authorities, and a 5 year suspension, beginning in 1999 was the result. In my opinion, JJ (and possibly the other boys) got away with it in order to preserve Dillon's high conviction rate - it was a high profile case and it was an election year. He was a very ambitious man. Sorry if I offend anyone, but I think he had a "God complex" and was convinced that if it was good for him, it was good for his constituents too. Hey Junior Sleuth, Opus Dei is OK with you? Just a little harmless hobby? Please. If the evidence pointed at a possibly abused minor, maybe it made things a whole lot simpler to not include that evidence. It's nice and neat, because Robert won't admit to being abused and he can't admit to abusing JJ either. He can think of himself as a 'stand up guy' for not ratting out the brother he supposedly looked up to. He's not going to testify, either, so that's certainly helpful. The info LBS revealed about the rampant abuse going on at the Golub house provides the missing link in this case. for me anyway. That was certainly not something that came out 22 years ago, and once you consider that, it makes a lot other things fall into place about how decisions may have been made about whom to indict and prosecute. I'm not saying there was some huge Catholic conspiracy, I'm saying it is not far fetched to think they played a part in getting JJ out of town. It probably wasn't going to be easy to keep that big mouthed creep of a kid safe in school, either, a BIG headache for the school district. So it's one thing to say the taxpayers came up with the money to send JJ away to school, but in order to get him into 2 Catholic Jesuit run schools, (and yes, both LaSalle and Fairfield were Catholic, Jesuit run schools)the Catholic Church most certainly would have become involved. And I still don't think taxpayer money went into the Catholic Church's bank accounts on this. Just doesn't make sense. I also do not think the Golubs paid the tab. I think the Church did. They would have considered it a work of "charity ". What I have a problem with is all the secrecy about it. And, poof! A (troublesome)mater ial witness to a murder is gone, just like that. Lucky little bast**d, isn't he? And just think - thi served Dillon's needs, it served the school district's needs, it served Liz Golub and her Charismatic group's needs and it also happened to serve the needs of that piece of garbage, JJ. And if the Golub parents helped in the clean up, having Robert take the rap for everyone was such a nice way to go. Robert is not innocent, no way. And I do not think he has ANY chance of parole. He has to show remorse for his acts in order to even be considered for parole and he still says he's innocent. Yes, we all know that polygraphs are not admissible in a court of law. We still really don't know if Robert passed one or not, and it wouldn't matter either way. We were told at the time of JJ's (and SB's and GM's) polygraphs, that they all passed "with flying colors" and we now know THAT to be a lie, thanks to LBS. Last, I wouldn't have problems with getting the press involved, but the local press is dependent on the DA's office and the NCPD for its sources, so I do not have a lot of hope that they will come through for us. They are afraid to mess with the people who give them the info to write their stories. And even the retired ones, who may know details that weren't reported, do not seem inclined to get involved and help, and that is a shame. We need national attention -- from the media, from the FBI, from the Justice Department, from wherever, but I do not expect help to come from any local media. We also need someone who has information and is enough of a human being to come forward with it, even if they have been told by some authority figure to remain silent. Any human beings out there? Hey JTN, what about O'Grady? Please re-post. I always wondered about the whole lawyer setup on the Golub side. First it was McGoldrick, the lawyer friend from Keystone Yacht Club, who halted all questioning of the boys. Then he supposedly changed to only representing JJ and his parents. So Robert went and talked to police alone. He was there for hours, until McGoldrick supposedly called the police the next day and had the questioning halted. Next, you hear the Golubs can't afford a lawyer, and O'Grady brings Robert in (and the stories said that Robert passed a lie detector test, but who knows if we can even believe that.) Finally, Robert is represented at trial by Sal Marinello, who I have a feeling got paid, but I don't know for sure. Then another lawyer handles the appeal, and again, I have no idea as to the financial arrangements. Just for the record, I have nothing against lawyers. Defendants are entitled to representation. In NY, the laws are pretty extensive when it comes to enforcing the rights of the accused before trial. These laws had a lot to do with why it was so difficult to get evidence early on, I think. Robert sure looks like he was in it up to his ears, but he wasn't alone. It sure looks like he was offered up as a sacrificial lamb, though. The lawyer details are murky. Anyone have any info? I'm pretty sure that is the address of the Hooters in Paramus NJ where JJ used to work. There's also a La Quinta Motel at that address, but I doubt he lives there. Judging from the reviews online, he'd be right at home; the place sounds like it leaves a lot to be desired in the cleanliness department. Actually, it would probably be a giant step UP from the way he lived on Horton Road. It's possible he received his mail there, which is why that address may have come up for him on one of the many address/people finders sites online. I've heard that when he left Hooters, he may have gotten a job at a nearby TGIFriday's. How anyone would hire this creep to work around young women is completely beyond me. If the families of the other two boys read here, I'd really like to ask them a few questions: - If any of you now have children of your own, do you ever put yourself in the Tinyes' family's shoes and imagine how you would feel if one of your own kids was murdered by a neighbor? - How would you feel about anyone who stayed silent in order to protect people who were there the day your child was brutally murdered? - HOW DO YOU SLEEP? It seems most unlikely that the school board would pay both private school tuitions at LaSalle (a Catholic school) and Fairfield (also Catholic). I understand that someone may have claimed otherwise, but it is highly unlikely that a public school board would have voted to use funds in that manner. Doesn't make sense. An earlier poster asked for the name of the Church group Mrs. G went to. It was just the regular Tuesday night prayer group at St. Joe's in Hewlett. I think it still meets every Tuesday at 8PM. Thanks for your recent post, Last Boy Scout. I too agree that public opinion is powerful. And if you do post that recording on YouTube, I for one will be posting links to it everywhere I possibly can. A national audience, possibly a worldwide one, would be very helpful. I am pretty sure all of us here would help to spread the word everywhere. And yes, it has been interesting to watch the developing situation with regards to the Nassau County Crime Lab. For those of you who are not aware of what has been happening, the Nassau County Crime Lab has been shut down. It's the only one in the country to have received that sanction. The problems it is being cited for supposedly go back to 2007, when the lab last passed inspection: http://abclocal.go .com/wa...l/long_i sland&id=79668 26 In a related story, Kathleen Rice's request to appoint a special prosecutor to investigate the crime lab situation was turned down by Judge Donnino. Looks like the Judge expects her to do her job, even if it means investigating and prosecuting members of the Police Department: http://abcnews.go. com/US/...Story?id =12993023&page =1 Did these tainted crime lab results only begin in 2007? What if the evidence testing that went on in the Tinyes case was handled improperly under Denis Dillon? Is it possible that the course of the Tinyes 'investigation' was determined early on, when Denis Dillon allegedly decided that only one of the Golub brothers would be prosecuted, in spite of the fact that others were present in the house at the time of the murder? The post by The Last Boy Scout 'fills in the blanks' for us about why this decision may have been made. The so called half-a-loaf theory, if true, might indicate that the Nassau County Police Department and the DA's office under Denis Dillon tried, in effect, to 'play God' and that is NOT the way the American system of justice is supposed to work! I admired Kathleen Rice for re-opening this case, but wouldn't her constituents expect her to follow through and finish the job that she started? If she can't, don't we need to find someone who will? If the leadership of the reinvestigation isn't serious about getting to the bottom of this, is there a way to involve the Justice Department? It wouldn't be the first time a local police department wasn't able to properly investigate itself. And if Kathleen Rice can't or won't -- don't the PEOPLE have a right to expect a REAL re-investigation? And this time, the chips need to fall where they may. The truth needs to come out.
