Poor noggin, after 200+ years of our court system evolving to our present interpretation and application, you can take all your "should-s " and file 'em away- we are already WHERE all your "should-s " should be. Pity they don't coincide with your opinions. Look at it thisaway (since this is the interpretation dictated by your "should-s "), we as a society have to wait until a crime has been commited, i.e. wait until property is destroyed or stolen, wait until victims are dead or injured, wait until banks are robbed, wait until people are raped, wait until drugs are purchased- in short WAIT until it's too late to PREVENT a crime when all the evidence would, could and WILL point towards a crime being planned and prepped for. Did you happen to notice that the Law has verbage using the word "reasonable "? I personally know of a case where a guy was convicted of conspiracy to commit rape even though he hadn't got out of his car, he was caught in a campus parking lot at 1 a.m., (he wasn't a student, so tresspassing as well) in possession of a ski mask, handcuffs, condoms, handgun and a ball peen hammer. A "reasonable man" would see that the man was there SOLEY to kidnap and rape a student and that is what he was convicted on. By your posts, it's clear you aren't reasonable. No surprise there. Wrong (again), medical needs after one serves is a part of the benefits package one is entitled to, just as a worker in a civilian industry receives after leaving that employment, for medical needs earned as a result of the employment. IOW, if a Soldier OR civilian is hurt on the job, they're entitled to ongoing care even after leaving that employer.  (Feb 24, 2013 | post #2328)

You might want to google the term "inchoate crime" as well, as it's definition has a bearing on conspiracy and intent charges in criminal courts. At common law, the doctrine provides that "a defendant who shoots at B but misses and hits C instead" may be punished as he had intended to shoot C. You are without a doubt the winner of the "Trying to Remain Ignorant" award I have ever met. I JUST provided you with links from excellent sources to show you how intent is a part of the process, it demonstrates at grade school level how intent is easily proven and can at times be necessary as part of a conviction, it also brings to mind how a "conspiracy " is proven in a court of law. You continue to apply your inexperienced opinion as a the yardstick of how our entire judical system needs to interpret the law of the land. Should" has nothing to do with it. The law is clear on this. how it is processed is a different matter. I'm quite sure your points are opinions, as mine are from experience, starting with a BS in Law Enforcement. IOW, I've done my research, now you do yours. 10 pounds of heroin is percieved by law as "not for personal use", but for monetary gain, hence the "intent" is obvious.
