I brought up the "other distributor" issue a couple of weeks ago. In many of the C-stores around here, there are other distributors that bring in minis, small HBW and HMO pieces. I have gone around and around with legal for a year and a half. They claim since it is a slightly different size than what we carry, it is ok. I have found no where in the contract where it states you are buying the account except for a few items in different sizes. I have also in the past week finding thoses same size of HBW and HMO in Walmarts. There are usually a couple sticking in my shelf area that were probably stuck there from somewhere else in the store. I have not had time to see if they are actually stocked in quantity somewhere in the store.  (Apr 21, 2014 | post #5337)

I came in two years from outside the industry. I have run my own company before and understand business. i read and understood the contract and signed. The issue I have is that SL does NOT follow the contract and I was mislead (probably intentionally) about many things. The PA's I understand and accept but I was told promo was when something was on a sale or special. Walmart selling for the same price everyday is not a sale or special. Therefore 100% of what we sell Walmart has a PA with it, very misleading from what I was told. I was told I was buying an area. Now I am told no, you bought accounts. I was told I had exclusive rights to the accounts I bought but yet most of my C stores have other distributors bring in SL products. Legal tells me since they are a slightly different size, it is ok. I was told SL would have help available for me to hire to cover for me when necessary (they did for three months when I started) but got rid of them. I was told cross docks I would not have to handle but yet, it seems I spend more time dealing with them than I do product I bring in myself. I hope those of you that seem to think that since we "signed" that we should just deal with it, can see a pattern to how SL does business.  (Apr 14, 2014 | post #5305)

Has anyone else had isues with the so called "bonus" and been able to get it fixed? Mine is less than half what I expected and can not get an answer from anywhere. Also I heard today something that convinces me more than ever that the upper sales staff is crazy and has no respect for us personally, for ourtime and for our duty to out families to make a living. Although I do not think it will happen but they are considering having us take in a pallet to WalMart on Friday of an item on special. On Monday, we pick the remains. I have emailed about every third day asking for some clarification on my numbers for 3rd quarter bonus. Of course no amswer. Some weeks my SDV (which is one of my questions to them, how do they come up with this) is sometimes only a hundred dollars more than what I purchased. Also, they show how much my cross docks are and say they are in the totals but I can not see anywhere that they have been added in.  (Oct 23, 2013 | post #4770)

Has anyone taken a close look at their 3rd quarter bonus numbers? I know all the rules, I know it does not include partner brands and I know it is store door value. I am totally lost becasue the numbers just do not add up. I have a few weeks where my numbers they say I did this year were less than I bought at the warehouse. I think I need to go take a look at last year since I do not trust their numbers as being an accurate accounting. AM I the only that things this is just another SL game?  (Oct 3, 2013 | post #4624)

I have a tax question but please do not give your opinion unless you are a tax accountant. Has anyway had a TAX ACCOUNTANT prepare their taxes and did they write off 100% of the purchase price or did they amoritize over 15 years?  (Sep 30, 2013 | post #4600)

Here we go again. We have had this discussion often and we do not know or agree anymore than when we started. Most of the IBO's think they own a geographical area. SL contends we own accounts. There needs to be a lawsuit to decide that one (hopefully someone in PA will start one). I recently got an answer from SL legal when i questioned why many of the chain convenience stores that are in my contract as "protected " accounts are getting SL products from another distributor. My point exactly. There is a contract and they do not follow it. They do not even come close to adhering to IRS requirements to being treated as an independent contractor.  (Aug 31, 2013 | post #4396)

I did speak to Halunen this week. Did not get he attoney but spoke to a secretary so I do not know how accurate information is. Theyevidently have been contacted to do another lawsuitby sme IBO's but were not interested at this time. Did not get reasons why. I was not there the first time but it sures seems like nothing has really changed from whatI read and hear. It would be helpful if someone in Pennsylvania could start something. Disputes over territory, non exclusive rights for accounts we paid for, forced sales, etc etc  (Aug 30, 2013 | post #4394)
