California gay marriage trial takes national stage

The RATS (Roberts, Alito, Thomas, Scalia) on SCOTUS have already made up their minds, so this goes into the High Court with 4 of the nine justices letting personal prejudice drive the law. I think it's unreasonable to expect the other 5 to all go accept the equality arguments - this is still developing law, so the natural conservatism of the judiciary will maen at least one of the other 5 justices would also think this needs more time in the states to development. RDG: The Grating Oracle is scared to death to face reality. Even though new same sex couples can't currently wed in California, TGO doesn't want to talk about the fact the the prop H8 people didn't even try to take in Domestic Partnerships, because they knew they would lose in California (same as they did in Arizona in 2006). The voters of California accept that we exist, and know that it is wrong to deny us legal protections for our families. Once that decision is made, it's just a matter of time before the absurdity of calling opposite sex couples "married " and calling same sex couples "partnered " makes it inevitable that prop H8 goes the way of the Dodo, Plessy v Ferguson, and Bowers v Hardwick. Romer v Colorado, Lawrence v Texas, Prop H8. Equality for same-sex couples (and Gay people in general) are 2 for 3. Prop H8 fails any rational review, it's just a matter of a race between the courts and repeal efforts to extend marriage equality. Even Justice Scalia admitted in Lawrence that excluding us from marriage couldn't survive a challenge after the ruling in Lawrence. The current SCOTUS will not overturn Prop H8, because the RATS (Roberts, Alito, Thomas, Scalia) will let their personal prejudice color their legal reasoning. I don't think it it reasonable to see SCOTUS go out way because the other 5 justices would have to break our way, and one of them will be too squeamish to judicially correct the discrimination. This ruling needs to be 6-3 or 7-2, so it's a morbid wait for one of the reactionary justices to retire or die  (Saturday | post #453)

There is no such thing as Gay Marriage. There is no such think as straight marriage. There is civil marriage. , In 5 states (NH, effective 1/1/2010), and DC (effective in the Spring) this now allows same sex couples to enter this legal status on equal terms as opposite sex couples. THe application for a marriage license asks for identifying information, not who you want to sleep with  (Saturday | post #451)

DOMA does no such thing. Marriage doesn't need protecting from same-sex couples. It does need protection for selfish hets who marry and divorce with impunity. I'm looking forward to voting for the so-called Protect Marriage amendment next year which will ban divorce in California. In Lawrence v Texas, Justice Scalia bluntly states the bans on same sex marriage are not defensible if morality cannot be a factor in legal reasoning. http://www.law.cor nell.edu/supct/htm l/02-102.ZD.html State laws against bigamy, same-sex marriage, adult incest, prostitution, masturbation, adultery, fornication, bestiality, and obscenity are likewise sustainable only in light of Bowers’ validation of laws based on moral choices. Every single one of these laws is called into question by today’s decision; Justice Scalia is wrong in the incest, prostitution, adultery and bigamy laws, because there are valid social reasons to continue banning these, separate from the morality question. The legislature might choose to repeal these, but they will not fall based on Lawrence. They will easily survive on a rational basis review  (Friday Dec 18 | post #442)

Granted, it won't happen until after the next election now, but the demographics show continuing growth in support for marriage equality (not day by day, but year by year) Why? Because as more Gay people become known, the ban on marriage ceases to make sense to their family, friends, co-workers. Your problem is you don't have a single coherent reason Gay people should be excluded. Hiding behind tradition doesn't flyUntil it's repealed.
