2008 Acura TL Type-S

I have bought 2008 Acura TL type S and i have experienced problems when trying to shift in to third gear. It's just sometimes it won't go in and you really have to force it. Some times it will pop back into nuetral and some times it the car will grind gears. I have taken back to the dealer one time and they said that the car was not grinding gears and shifted into third perfectly fine. But i still receive problems with it even when i took it off the lot right after they told me. i have tried to live with it but i just cant take it any more. I had to pay almost $40,000 for this car and should not have to deal with it. I have driven stick since i was 16 and have never had a problem like this with my Chevorlet, Nissan, and Volkswagon. I am really turned off from Acura because of this experience. Has anyone had a dealer that has fixed this. I want to know what to say so i can get it fixed.
