Ex-PCI chief held in bribery case

Prosecutors on Monday arrested a former president of Pacific Consultants International (PCI) in connection with bribery allegations totaling 90 million yen in return for official development assistance (ODA) contracts in Vietnam.

Arrested along with Masayoshi Taga, 62, were former managing director Kunio Takasu, 65; Haruo Sakashita, 62, a former PCI director; and Tsuneo Sakano, 58, a former head of PCI's Hanoi office.

They are suspected of violating the Unfair Competition Prevention Law, which prohibits bribing officials overseas.

The scandal-ridden construction consultant company gave the bribes to a senior official of the Ho Chi Minh City municipal government in 2003 and 2006, sources said.

The money was paid as a reward for helping PCI win 3.1-billion-yen consultancy contracts for the city's highway construction projects in fiscal 2001 and 2003, sources said.

Taga and others are the first to be arrested on suspicion of giving bribes to foreign officials outside Japan.

Previously, two employees of electrical engineering company Kyudenko Corp. were ordered to pay a 700,000-yen fine for giving golf clubs and other goods worth 800,000 yen to two Philippine officials in Japan.

According to a summary indictment in March, the employees invited the Philippine officials to Japan in 2004 to entertain them.

The latest case is the first involving a project funded by Japan's overseas aid programs.

Investigators from the Tokyo District Public Prosecutors Office believe Takasu handed $820,000 (about 90 million yen) in cash to the Ho Chi Minh City official, who was in charge of highway and other projects, when they met in the city in 2003 and 2006, the sources said.

He was accompanied by Sakano during the meetings, the sources said.

The portion given in 2006 was authorized as company expenditures by Taga, who headed PCI's sales department at the time, the sources said.

Taga was indicted in June on a charge of defrauding the government of about 141 million yen in connection with a project to dispose of chemical weapons abandoned in China by the former Imperial Japanese Army at the end of World War II.

PCI asked Takasu, who left the company in 2001, to be the bagman--apparently because the company could then claim that it had nothing to do with the retired executive should the wrongdoing surface, the sources said.

Takasu headed a PCI affiliate in Hong Kong, which he set up to give kickbacks to win projects across Southeast Asia. He has admitted handing the bribes to the Ho Chi Minh City official, the sources said.

The statute of limitations for bribing foreign public servants was three years until the Unfair Competition Prevention Law was revised in 2005 to extend it to five years.

Even though the money given in 2003 does not fall under the statute of limitations, prosecutors believe that Takasu could be charged since he lived overseas for much of the time.(IHT/Asahi: August 5,2008)
