Wow, I gotta say hearing this story kind of pissed me off.
Those dumbasses at customs discriminating against Samoans? I think they were hoping that the baby died. If I was on that flight, I would have called 911 or knocked out a few custom guys and rush that baby to a hospital. Those custom guys are nothing but a bunch of dehumanized trash devoid of a human heart and common sense. This act by them shows what they think of Samoans. The sad part is, Hawaii is a Polynesian island taken over by the Americans. To be treated like this from self-entitled rent-a-cop douchebags with huge egos and 0 sense of compassion takes a lot of nerve even from these mindless cowards. |

i have to suspect the mother and the nurse and the sickly baby taking a commercial flight and not having the paper work in order...BUT regardless. We had a dying baby with someone saying the baby would die.
i have no idea what their rules or regulation states....i'd would've breaked it and call an ambulance myself to have the baby checked and then transport the baby and sort out the paper work later. most times is some power trip HPD wanna be flunkie that would call the shots and try to show they are up to task. NOT!!! Like that cop that excericised his authority to some football player on his way to see his dying mother in law...because cop pull the gun and HAD to give him a ticket...screw that! Why can some cops give people warnings and some feel so obligated to sustain the law in dire circumstance...they they apologized after they discover how wrong they were. |

Customs, like airport security, think they are above God. Which allows them to treat us any way they want. They ought to fire 10% of the staff every year and replace them with better trained personnel

I am soooo disgusted about this! I can't believe how STUPID & IGNORANT these people were, LOCKING UP a very sick baby in a room that was rushed from a U.S. territory?! ARE YOU KIDDING ME? Here goes a mother so desperate to do anything to make sure that her CHILD gets WELL and then gets LOCKED UP at a US state to get ANOTHER APPROVAL?!! What happened to the CHILDREN COMES FIRST motto? huh? Even a certified & registered NURSE was present & offered to take the baby while the mother awaits to get ANOTHER APPROVAL from you; BUT you guys TURNED THAT DOWN TOO?! Something is totally WRONG HERE!!!!

The truth is custom officials are fully responsible for the wrongful death of baby Michael Tony Futi, bottom line. I strongly advice Luaipou Futi's attorney to look at the posibility of prejiduce juries where a court trial will take place, if so than request to shift to a different court even to any states of the United States. Local Hawaiian are prejiduce of American Samoan citizen, unless a judge wiil ensure there are American Samoan citizen on a jury, beside the Hawaiian look at the matter is not a local issue so they protect their local employees. Californis court is your best bet.

That is very sad, a child died because of some stupid custom. how heartless and cruel can they be. My heart goes out to that mother and her child. Money can not replace a child no matter what amount, but she deserve to get something out of all the pain and suffering she went through. That childs life should have taken main priority over some stupid custom.

What a sad commentary "it was a long-shot", I guess you would know how it feels when someone has a "long-shot" chance. I mean who cares right? According to you the baby was sick and it died so what? How callous you sound. I don't mind you defending the Custom Agents, cause you're right they were doing their job, but common sense sometimes needs to prevail. The story doesn't say the baby's papers weren't in order nor does it say the nurses papers weren't in order, just states the mom's papers weren't in order. So what would have been the problem to release the nurse and the baby. I guess they thought the baby was a terrorist or maybe the nurse wasn't a nurse. All I know is this, if these agents have a conscience or even a heart they're reliving this day over and over, and when the case goes to trial they'll relive it again, and I bet you anything there second guessing themselves if they did all the right things. As for her lawsuit, she didn't get on the plane thinking ok today my baby's going to die and I can sue someone, so give me a break on that statement about the quick buck. You should remember America is a sue country, and we who are born and raised out of the mainland learned this form of compensation from the mainlanders. |

this is a awful tragedy, my condolences go out to this family on their loss of such a beautiful baby! what is this society coming to? common sense at any level would have the at least let the nurse with documented papers and the child go on the hospital. because of u.s. customs ignorance an innocent child paid the ultimate price, his own life. i hope and pray that Futi and her ohana get everything they asked for. unfortunately all she wanted was to get help for her litte baby Michael, in return all she has to look foward is planning a funeral for him.

This is truly sad...I'm sure there are more qualified and credible individuals employed by our government than the idiotic and retarded officer who is responsible. Where's the common sense? Where were his superiors? He was more concerned for legit paperwork over the life threatening disease that could claim the life of this child.
Although there will never be enough money to replace this mother's loss, our government need to thoroughly scrutinize hiring requirements and psychologically process applicants so were not just hiring the next neanderthal with good credit and clean criminal backround because to me that just means-they never paid bills cuz they lived with their parents and they've never been caught sodomizing themselves. |

No settlement at mediation does not mean that there will be no settlement before trial. Customs will not be in negotiations if they did not feel that liability rest in their court. Between now and trial they will reach a settlement. A federal judge will award this mother a big settlement and the Feds know that.
