St. Paul / Hmong groups spar over identity
Suit says former staffers took cash, used similar name

What's the difference between the World Hmong People's
Congress and the Congress of World Hmong People?
Not nearly enough, according to a lawsuit filed
Friday.
The World Hmong People's Congress, a St. Paul Hmong
advocacy group that filed the suit, claims some of its
former members broke off and formed a rival group in
Minneapolis using more than $75,000 taken from the old
organization. It says the group then tried to cash in
on the similarity of the two names.
But the attorney for those being sued said the whole
thing is just an internal power struggle and that no
funds have gone missing.
"Both sides are claiming to be the true national
headquarters for this organization," lawyer Craig
Erickson said. "There's a whole history of this that I
can't get into right now."
Hmong scholars and community leaders have expressed
puzzlement over the infighting, saying the two groups
are small and have no real standing in the Hmong
community.
"I don't think your average Hmong person knows of the
existence of these organizations," said state Rep. Cy
Thao, DFL-St. Paul. "It's the first time I've heard of
them."
The attorney for the World Hmong People's Congress
declined to comment, saying he could not speak without
consulting his clients first. Attempts to reach board
members were unsuccessful.
The suit, filed in Ramsey County District Court, names
as defendants the board of directors of the rival
Congress of World Hmong People.

suit, a volunteer treasurer for the nonprofit World
Hmong People's Congress took more than $75,000 from
the group from November 2005 to January 2008.
In December 2007, the suit states, a group of
volunteers secretly filed papers to change the
organization's legal name to Congress of World Hmong
People.
Staffers caught the change and canceled it, the suit
states, but in mid-January, the volunteers established
the nonprofit Congress of World Hmong People on their
own.
The suit says that the new group's name was too
similar to the old one's and that the organization's
directors passed themselves off as the new embodiment
of the old World Hmong People's Congress.
The new group used the old logo and raised funds "by
misrepresenting" itself, the suit states. As a result,
it claims, the World Hmong People's Congress lost
donation revenue and suffered "unfair competition."
The new organization also went so far as to lay claim
to more than $27,000 that the World Hmong People's
Congress had in a Maplewood bank, the suit states.
It also has legal documents and more than $10,000 in
furniture and office supplies that the World Hmong
People's Congress says it wants back, the suit states.
The World Hmong People's Congress wants the other
organization to stop using its name and to give all
the money the organization earned by using their name
to them, according to the suit.
Erickson said his clients have wanted the organization
to remain in St. Paul. But those who brought the suit
"are interested in seeing the national headquarters
relocated to Fresno," he said.
Fresno, Calif., has one of the nation's largest Hmong
communities.
