He is claiming that present-day Philippines is the succesor state of the myriad of kindgoms, sultanates and tribes that lived in the Philippine archipielago before the Spanish arrived. That doesn't mean that those groups had a claim on the Spratly islands.

Exactly. And the Spratleys and Scarborough shoal are their ancient or traditional sailing and fishing grounds since a hundred thousand years ago because, like today, those are areas with guaranteed abundant fish supplies.

They have a claim because those are their ancient fishing grounds, and also today it's within their Exclusive Economic Zone defined by UNCLOS. Ancient rights and modern international laws are both in their favor.

They have the balangay sailboat to regularly fish in those areas that have guaranteed abundant fish supplies. Their descendants have a right to fish in those areas like their ancient ancestors did.

My friend. It seems China is choosing to alienate several countries under the risk of future conflict and hatred towards innocent Chinese travelling and living abroad.

I heard China is developing fusion reactor technology. Eventually the Philippines and all countries of the world will also adopt that safe and clean technology in the future as well. By that time the Philippines and all countries around the world can build its naval defense capability that can rival China. It seems that you guys have chosen the risk of challenging all of us once our naval might has surpassed yours thanks to those fusion reactor technologies and other technologies you are developing. I'm sure it will happen a few generations in the future. Better learn from the Ancient Romans my friend. Superpowers rise and fall.

UNCLOS?

Declaration under article 298:

The Government of the People's Republic of China does not accept any of the procedures provided for in Section 2 of Part XV of the Convention with respect to all the categories of disputes referred to in paragraph 1 (a)(b) and (c) of Article 298 of the Convention.

The Philippines has also added modifications to UNCLOS for the same reason as a condition for endorsing it.

Flips tried to make sure that no one among the neighbouring countries can use UNCLOS to claim its land.

But now flips turn around to use UNCLOS to claim land from other countries.

Funny!

The ethnic Chinese in the Philippines have rightfully earned their properties through hard work and creativity. We coexisted and or intermarried with our Aeta countrymen for tens of thousands of years. We don't prevent the Aetas from fishing in the Spratleys or at the Scarborough Shoal because they are our fellow citizens. We didn't make them beg on the streets. They chose to beg on the streets and to not adopt western ways.

I believe China is a member of ITLOS. So why would such a member not follow its laws the UNCLOS?

And we eagerly await for China to develop and share the fusion reactor technology to the world. We will use it to put some steroids to our military. Then let's get ready to rumble several generations from now.

article 298, paragraph 1, allows States and entities to declare that they exclude the application of the compulsory binding procedures for the settlement of disputes under the Convention in respect of certain specified categories kinds of disputes. Article 298, paragraph 1, reads:
"Article 298. Optional exceptions to applicability of section 2

"1. When signing, ratifying or acceding to this Convention or at any time thereafter, a State may, without prejudice to the obligations arising under section 1, declare in writing that it does not accept any one or more of the procedures provided for in section 2 with respect to one or more of the following categories of disputes:

(a)

(i) disputes concerning the interpretation or application of articles 15, 74 and 83 relating to sea boundary delimitations, or those involving historic bays or titles, provided that a State having made such a declaration shall, when such a dispute arises subsequent to the entry into force of this Convention and where no agreement within a reasonable period of time is reached in negotiations between the parties, at the request of any party to the dispute, accept submission of the matter to conciliation under Annex V, section 2; and provided further that any dispute that necessarily involves the concurrent consideration of any unsettled dispute concerning sovereignty or other rights over continental or insular land territory shall be excluded form such submission;

(ii) after the conciliation commission has presented its report, which shall state the reasons on which it is based, the parties shall negotiate an agreement on the basis of that report; if these negotiations do not result in an agreement, the parties shall, by mutual consent, submit the question to one of the procedures provided for in section 2, unless the parties otherwise agree;

(iii) this subparagraph does not apply to any sea boundary dispute finally settled by an arrangement between the parties, or to any such dispute which is to be settled in accordance with a bilateral or multilateral agreement binding upon those parties;

(b) disputes concerning military activities, including military activities by government vessels and aircraft engaged in non-commercial service, and disputes concerning law enforcement activities in regard to the exercise of sovereign rights or jurisdiction excluded from the jurisdiction of a court or tribunal under article 297, paragraph 2 or 3;

(c) disputes in respect of which the Security Council of the United Nations is exercising the functions assigned to it by the Charter of the United Nations, unless the Security Council decides to remove the matter from its agenda or calls upon the parties to settle it by the means provided for in this Convention."

We will learn those inter planetary technologies like Twitter and smartphones. Because technologies nowadays, they are designed to be user friendly. When it comes to literal war. I'm sure the Filipinos have proven that they too are fierce warriors. Well by then war will be simple as pushing buttons. The fusion reactor technology will be an equalizer to all countries. Meaning, by then all countries can go to the moon and mars as well thanks to fusion reactor technologies. China better humble itself and behave or all countries will unite to teach you humility thanks to ITER.

Does China Want To Own The Moon?
OCT 20, 2011 03:00 AM ET // BY IRENE KLOTZ

THE GIST
Within about 15 years, China could have a permanent presence on the moon, and be laying claim to its resources.

There may not be anything the United States, hobbled by debt and politically polarized, can do to stop China.

By the time U.S. astronauts return to the moon they may need permission to touch down from China, which is laying the groundwork for a lunar land grab, says long-time space advocate and entrepreneur Robert Bigelow.
