I would recommend that you talk to a lawyer but here is some free advice that shows why you should talk to a lawyer....

If you have a valid (unexpired) Chinese passport and have not taken up citizenship in another country then you should be able to enter China with no problems, register your address where you choose to live and get on with your life.

However, I would guess that your passport was issued more than 5 years ago and is therefore out of date. That would mean that you would have to argue your case and I am guessing that that is going to be difficult because without a valid Chinese passport you can only get limited access as a visitor and, if you haven't got any passport then you aren't going to get a visa. Equally, if you have got a passport but it is issued by a country other than China then, as soon as the Chinese are aware of that then they will revoke your Chinese citizenship.

Apart from marrying a Chinese citizen which will only entitle you to residency here (providing you have a valid passport from a foreign country) you would still not qualify as a Chinese citizen and would have to apply for residence permits every one to three years and if you failed to do so they would repatriate you back to Myanmar.

Your best bet, therefore, is to take your Chinese birth certificate plus your expired passport and any other official Chinese registration papers to a Chinese Embassy and see if they will give you a new Chinese passport.

Alternatively, yes, it does sound like you might effectively become a stateless person, however, unless Myanmar can find a way to repatriate you then it sounds like they are stuck with you and either way you have somewhere to live.

If you have a Chinese passport, then why are you confused about your nationality?

You don't need to get Chinese nationality. You already have it.

^^^^^ This.

If you have a good education then you'll be able to emigrate to the developed world. Why on earth would you want to live in China?

Err, think about it! He's almost certainly a Chinese national, he speaks the language, the country where he lives will not give him citizenship and that suggests that it would be difficult to persuade another country to accept him since Myanmar are not going to give him a passport so that he can travel. So Myanmar's problem and they will pass the buck to the Chinese because he has not and is not likely to be declared stateless since he holds a Chinese passport.

So tell us, just how long have you lived in China or are you just prepared to judge a country from a trash tabloid in Scotland trying to fill column space?

He should go back to China, make money. Then return to Burma as an investor. He will be welcomed back there.
