Whether Beijing will agree, in the Philippine case, to the arbitration procedure outlined in the very Law of the Sea, the arbitration provisions under the so-called Annex VII themselves allow for compulsory proceedings; Article 9 includes the principle that “ABSENCE OF A PARTY OR FAILURE OF A PARTY TO DEFEND ITS CASE SHALL NOT CONSTITUTE A BAR TO THE PROCEEDINGS.”

CHINA: Philippines/China South China Sea dispute - DO NOT USE UNCLOS as basis

When China suffers from a disadvantage, however, multilateral dispute-resolution mechanisms become an option. In its dispute with Japan over a handful of islands in the East China Sea, which the Japanese call Senkaku and the Chinese Diaoyu, for example, Tokyo enjoys the distinct advantage of possession. To counter this advantage, Beijing filed a submission before the Commission on the Limits of the Continental Shelf (another Unclos forum) just last month seeking information “concerning the outer limits of the continental shelf beyond 200 nautical miles in part of the East China Sea.”

It is very clear that CHINA is scared of the COURT because she has NO LEGAL BASIS!

just as no one question the western big power like usa, france and UK and their ownership of islands and oil in the pacific ocean which is 10,000 kilometer from their mainland

in the same way, no one will question China for its ownership of south china sea isle which is only 1,000 kilometer from china mainland.

China is a big country with big land, big population and strong military. it is normal for a big country to have a big land, big population, big sea territory, strong military power.

China land territory is 9,600,000 square kilometer, at land of this massive size, it is normal for China to own large body of water also.

China only own the isle in south China sea. so it does not own the water and have no effect in international navigation.

First of all, your HISTORICAL CLAIM is BULLSH*T

the HISTORY WORLD KNOWS THAT THE CHINESE WILL LATE COMERS TO THE SOUTH CHINA SEA. Science can prove that too thru archaeology and anthropology.

Secondly, if China has evidences then why is SHE scared to go to the court?

Is going to the court hard?

lol

It is not hard to go to the court!

Since BILATERAL TALKS did not work (its been a long time since 1995), going to the UN COURT is the EASIEST way!

You dont have to fire a SHOT.

But I guess CHINA is SCARED because SHE HAS NO HISTORICAL AND LEGAL BASIS.

communists see you in the court!

Now the world knows CHINA'S claim is ILLEGAL!

Every newspaper/ news articles in the WORLD, every country, says CHINA refused to go to the court! Because she has no legal basis!

Is that why CHINA is SCARED of the UN COURT? lol

Its too late for CHINA already

NO MORE BILATERAL TALKS!

The Philippines has FILED the CASE!

They submitted it to the UN already.

China has to answer if she DOESNT WANT international condemnation by UN countries!

The decision will INVALIDATE CHINA'S claim and LEGALIZE the Philippines' claim.

The JUDGEMENT will JUSTIFY US/NATO Intervention in the SOUTH CHINA SEA

US/NATO, japan, ASIAN BIG 6, India, Australia and New Zealand can USE the JUDGMENT by the UN to push away CHINA "LEGALLY".

Bilateral "PEACEFUL" Talks? We all know that's BULLSH*T. China wants no other countries involved because they know that through bilateral talks, they would have the chance to win this case unlike if this was made international, the whole world is going to see their stupidity owning the islands that are OBVIOUSLY not theirs.

From your replies, it seems that you are the "monkey head". Is every Chinese like you? If that was the case, then it would really be hard to settle this even if you are faced with mountains of evidences supporting the claim of the Philippines. I had noticed this from an observer standpoint, if an evidence is backing your claim, you EMBRACE it, but if it is against your claim, you dismiss is as foolish and even ridicule it. You Chinese people (well, some of them) have no consideration of the "other side". All you know is that you are the only ones that is right and everything that others say is wrong.
