PH draws German backing on sea disputes with China
MANILA, Philippines – A German foreign minister on Thursday expressed his country’s support for the Philippine position to solve its sea disputes with China under international law, saying that peaceful resolution was best for the two countries. In a press briefing Thursday, German Federal Foreign Minister Guido
Guido Westerwelle AP said that the Philippines’ territorial disputes with China over the West Philippine Sea (South China Sea) were discussed during a meeting with Philippine diplomats and officials and that his country remained supportive of peaceful resolution of the disputes.
“We appeal to all sides to resolve all the questions in accordance with international law and in a peaceful and cooperative way,” Westerwelle said in a statement.
Westerwelle and a 12-man delegation from Germany were in Manila for a two-day visit, the first by Germany’s top diplomat to the Philippines in 12 years.
For his part, Foreign Affairs Secretary Albert Del Rosario said that he conveyed to his foreign counterpart the Philippine initiative to bring the territorial disputes before an arbitral tribunal under the United Nations Convention on the Law of the Sea (Unclos) to “clearly establish the county’s sovereign rights and jurisdiction over its maritime entitlements in the West Philippine Sea.”
“I asked him to continue supporting the Philippine effort for a peaceful and durable solution to this dispute,” Del Rosario said in a statement.
Westerwelle, when asked by reporters to explain Germany’s support, Del Rosario said that a German professor of international public law was appointed as a judge to the tribunal, and that “all countries in the region, the European Union, have an interest in a stable and peaceful development.”
“The Association of Southeast Asian Nations (Asean) and Chinese economies are closely linked by a free trade agreement and this shows us (that) everyone gains from cooperation and not confrontation,” Westerwelle added.
In its “notification of statement and claim” filed before the UN, the Philippines said that it had appointed Judge Rudiger Wolfrum, a German professor of international law who served as president of the International Tribunal for the Law of the Sea from 2005 to 2008, as part of the arbitral panel .

Invoking the Unclos, the Philippines haled China to the UN arbitral tribunal in hopes of compelling Beijing to respect Manila’s exclusive economic zone (EEZ) and continental shelf encompassing territories in the West Philippine Sea.
China, however, had maintained that it has indisputable sovereignty over the area and that talks should only be on a bilateral basis with the countries directly involved.
Del Rosario, during the briefing, noted that based on his understanding, the Philippines’ international partners, including the European Union, had taken the position that “we should seek a peaceful resolution to this dispute and the process of arbitration is considered a peaceful means in seeking this resolution.”
Del Rosario also noted that the Philippines and Germany were taking steps to “re-invigorate defense relations” and that a delegation from the German Ministry of Defense (MOD) would be visiting Manila next week to “conduct bilateral discussions” with Philippine defense officials.
Asked whether discussions would involve exchanges in military training or procurement of defense equipment, Del Rosario just said that years ago, the two countries had an agreement which led to the training of Philippine military men in Germany and that the visit of German defense officials was part of a “current initiative to revisit and expand that.”
“There will be a German military delegation that will be arriving to revisit this initiative and to work themselves into the possible drafting of a memorandum of understanding that would formalize other means of cooperation,” he said.

My money is on China having administrative control of the South China Sea. The countries involved may never agree on de jure ownership but China will have de facto ownership. In light of recent events between the Philippines and Taiwan and Philippines and Malaysia, I think having China keep the area safe from trigger happy invasive Filipinos is not a bad idea.

I'm just being realistic. I highly doubt the "International Community" or NATO will do anything. China wouldn't be the first country to ignore a decision by an UN body - we've done it before and so has Russia, Israel, etc...

On the other hand, the Philippines, other than being a nice source of cheap labor and "entertainers", really is not important at all in world affairs.

When you Pinoys become more honest in handling this Taiwanese fisherman tragedy.

You guys (officials in Manila, your media, and many Internet users) have repeatedly sending our lies to smear the dead man and his crew.

You guys said (1) the Taiwan fishermem were within your sovereignty waters (12 nautical miles zone).

(2) The fishermen have destroyed or thrown away the VDR (something like a black box) of their boat. This device recorded their navigation details and positions of their voyage.

The news just came out from Chinese newspapers of Taiwan, Hong Kong and overseas communities this morning (HK time) indicated that Taiwan Police has obtained the VDR (black box), and successfully analysed the recorded content.

Black box analysis clearly indicated that the boat was 50 nautical miles away from the edge of your 12-nm zone.

Position of the Taiwanese fishing boat when they were attacked by Pinoys:

Latitude: 19 degree 50'~20 degree 10' Noth; Longitude 122 degree48'~ 123 degree 25' East.

Definitely they had not entered Philipines' sovereign waters yet, and they were still in Taiwan's EEZ.

Pinoys, be a man, and stand up to admit your mistakes with courage, please. Don't smear the dead!

The world is watching your shameless behavior.

The satellite record showed that the ship was positioned at 122 degrees and 55 minutes east and 19 degrees and 59 minutes north when it was attacked at 10:12 am, according to the fisheries agency.

However, a check on a maritime boundaries geodatabase online showed that the latest coordinate given by Taiwan's Fisheries Agency is even closer to Philippine land - and still within the Philippines' exclusive economic zone.

The Taiwan Coast Guard map also said the shooting incident happened at 9:45 a.m., which is earlier than the time given by its Fisheries Agency.

Taiwan findings support PH Coast Guard account: documents

MANILA (2nd UPDATE)- Initial findings made by Taiwanese agencies on the incident that led to the death of a fisherman near Balintang Island in Batanes last May 9 support the initial report of the Philippine Coast Guard (PCG) on where the clash happened, according to documents uploaded on the Internet by the Taiwanese government.

One Taiwan Coast Guard Administration (CGA) document, "f1368153033684.pdf" , shows a map where the incident took place between Taiwanese fishermen and the Philippine Coast Guard-Bureau of Fisheries and Aquatic Resources (PCG-BFAR).

The shooting incident ocurred in one of the coordinates on the map, 19°58 N 122°58 E.

It is inside the Philippines' exclusive economic zone and waters set by international treaty limits.

The location is 1.8 nautical miles south outside Taiwan's control border at 20 degrees north latitude, according to the CGA document.

Another coordinate, 19°50 N 123°24 E, is also within the Philippine jurisdiction. The location, 10 nautical miles outside the Taiwan control border, is where the Taiwanese fishermen operated.

A third location (20°07 N 123°01 E) where the fishermen called for help from Taiwanese authories is 5 nautical miles within waters that Taiwan claims.

According to an initial PCG report, its personnel tried to board several Taiwanese vessels after detecting them in Philippie "archipelagic waters.”

Another Taiwanese government document, "351516203472.pdf" that was uploaded on its Ministry of Justice website, shows trajectories of bullets that hit the fisherman's boat, the "Guang Da Xing 28."

It showed 59 bullet trajectories hitting the boat, as earlier stated by the Taiwanese government.

Most were focused on the boat's bow (front) and stern section (rear) and one bullet trajectory, with number "10" highlighted.

The PCG said it fired a warning shot when one of the foreign vessels was about to ram a Bureau of Fisheries and Aquatic Resources (BFAR) vessel.

"Meron silang nadetect na apat na foreign fishing vessels in archipelagic waters. In an effort to apprehend or magbo-board po sila… Nung sinusubukan pong to board… one of the vessels, ni-ram po nung isa ang ating, the BFAR vessel which is being manned by the Coast Guard. So nag-fire po ng warning shot, hindi pa din daw po tumigil 'yung mga vessels in an attempt to continuously ram the BFAR vessel," deputy presidential spokesperson Abigail Valte said last May 10, citing the initial PCG report on the incident.

She said the Coast Guard then took defensive action, firing on the ship's engine area to disable it.

"Nag-fire daw po sila ng isa pang shot doon sa machinery portion ng ship," Valte said.

"It was an aggressive act. The ramming of the boat into our vessel was certainly an aggressive act. So the PCG responded accordingly. Nag-warning shot sila, hindi po tumigil. They took the other necessary action and I understand eventually disengaged after that," she added.

The Taiwan government documents are currently innacessible but can be viewed through their cached versions via internet archive site web.archive.org .

Meantime, Taipei is insisting that the death of fisherman Hong Shi-cheng is "cold-blooded murder" and denied that the boat tried to ram a BFAR vessel.

Taiwan is also claiming that Philippine Coast Guard vessel "sailed away without offering assistance to the stricken boat, in violation of international law and a humanitarian duty."

"No claim of self-defense can justifiably be made by the Philippines," Taiwan's Foreign Ministry said.

"The Philippine claim that the incident occurred in its exclusive economic zone (EEZ) is unfounded. The incident occurred in the two countries’ overlapping EEZs," it also claimed.
