Prior to the end of the Chinese civil war I believe that Taiwan was administered by a Chinese governor appointed by the KMT in mainland China. The KMT were the ruling party in China prior to the civil war and left China for Taiwan when they were beaten by the Communists. The new government have never dropped their claim that Taiwan is part of China and the Taiwanese government have never declared independence from the mainland.
So your stating that China has only recently claimed sovereignty of Taiwan demonstrates your lack of understanding in international affairs! I also think you should do a little more research on Scarborough shoal and look at some pictures of it.
Taiwan has been independent since KMT moved from Mainland China to Taiwan, has her own flag, foreign policy, economy, immigration, etc. until mainland China declared to the world that there's only one China. This started the one China policy which Taiwan does not recognize. Unless mainland China change her government to democracy, Taiwan will remain separated coz mainland Chinese stinks.

I am glad that someone finally agreed to arbitration. Both sides I'm sure are hopeful that this will be settled peacefully through a legal process.

This forum is a very clear example of why the international community needs to get involved, as you can see forum posts come from different countries like Australia, Canada, new zealand, etc... And not just china and the philippines, Vietnam Brunei . It is an international issue, that needs to be addressed by the international community.

So why is China avoiding international arbitration?

And to those people here in the forum clearly not from china but who insist on bilateral talks joining this "multilateral/internation al" forum in the first place?

I believe that China is the legal owner because from my records they have claimed those areas long before the Phillipines did it. They have the historical proof for it. I try to be impartial here but only go by the facts I found in the library.

Historical? What historical facts? Old maps? I can also get old maps of Europe, and say that Italy owns the entire continent because of old Roman Empire maps. Or Napoleon bonaparte's maps so that France can also claim big parts of Europe. Or maybe Hitler's Nazi Germany maps perhaps?

China claims a body of water, an entire sea for goodness sake, what kind of greed is that?

Lets look at the present laws and base our objectivity on that. There is the Economic Exclusive Zone. The shoal is within the EEZ of the philippines based on international laws. Isn't that clear enough?

Then if they believe so, why are they scared of the court? lol if they have evidences. SUPER POWERS should be scared of the court....UNLESS THEY CAN'T prove their claim LMAO!

Also, International Law doesnt recognize Historical Claims

Can Italy claim all the ROMAN EMPIRE LANDS TODAY? Based on their OLD MAP?

If CHINA believes in HISTORICAL claims then return TIBET to the Tibetans, SINKING, TAIWAN etc to their FOUNDERS.

AND WHY IS CHINA CLAIMING THE ISLANDS? KUBLAI KHAN WAS MONGOL, IT SHOULD BE MONGOLIA IF ANYTHING.

Also, ACCORDING TO THE TRUE History BACKED by MODERN SCIENCE like ANTHROPOLOGY and ARCHAEOLOGY, the AUSTRONESIANS (ancestors OF THE FILIPINOS, MALAYSIANS, INDONESIANS, AND OLD VIETNAM PEOPLE OF CHAMPA) RULED THE SOUTH CHINA SEA DURING ANCIENT TIMES. The chinese were thousands of years late comers to the south china sea.

The Austronesians moved out of TAIWAN to the Philippines, Vietnam, Indonesia, Malaysia and to the rest of the PACIFIC islands 10,000-5,000 years ago which PREDATES any CHINESE RECORDS

The Ancient name of the south china sea was the "CHAM SEA"

names after the powerful austronesian kingdom of CHAMPA (MODERN DAY VIETNAM)

later on EUROPEANS named the area SOUTH CHINA SEA.

Austronesians ruled the AREA before the CHINESE even learned sea navigation.

“The seafaring history of the region at least for the first millennium of the current era was dominated by the ancestors of today's Indonesians, Malaysians, Filipinos and (less directly) Vietnamese (Austronesian Chams).” This statement at least is supported by current historical and anthropological knowledge.(Victor T. King,“Ethnolinguistic Groups of Southeast Asia,” in Southeast Asia: A Historical Encyclopedia, from Angkor Wat to East Timor, ed. Ooi Keat Gin, pp. 492-498, Santa Barbara, California: ABC-CLIO, Inc., 2004).

THE CHINESE WERE LATE COMERS TO THE SOUTH CHINA SEA

An Article from YALE UNIVERSITY

http://yaleglobal.yale.edu/content/chinese-hi...

As for claims to the South China Sea and its islands (referring to China) based on visits by fishermen ignore the fact that commerce in that sea, and into and across the Indian Ocean was run by Malay vessels and crews hundreds of years before Chinese mariners and merchants ventured far from their coast. Chinese Buddhist pilgrims to Sri Lanka went on Malay boats via Java or Sumatra. Nearly two thousand years ago Roman merchants brought spice island products from southern India whence they had been brought by Malay and Indian sailors. At much the same time, Malays with 20-meter ships with outriggers were crossing the southern part of the Indian Ocean, settling the huge island of Madagascar and leaving marks in Africa. Even today, after migration from Africa, Arabia and India, Madagascar’s human gene pool is 50 percent Austronesian and its language 80 percent.
The modern states that are the successors of those seafaring, migrant and trading Malays lack – unlike the Chinese – the written records to show their history. Nor is there much local elite awareness in those nations of their histories prior to the arrival of Islam and, very soon afterwards, of European traders and imperialists. But advances in archaeology, in genetics and other sciences which can make up for gaps in written history, are beginning to make the broad Malay world better aware of its past and of its right both to contest Chinese claims and resist further Han expansion into Southeast Asia.

So if you believe that china has the evidence to prove their ownership then I guess you agree that they should not be fearful of international arbitration. They should be confident enough to face the tribunal to state their claim. So why on earth are they avoiding it then?

The answer is plain and simple. "They don't have any proof. Even, the so called ancient map is nowhere to be found haha. Who knows if they just made it for themselves to satisfy their own belief. China is already a big and powerful nation. They should just leave their neighbor alone. Cooperate instead of trying to make a fast one. Greed will not make them powerful instead will make their downfall.

re: Negrito/Aeta

I told you, historical claims are not recognized under international law.

Can American Indians CLAIM THE WHOLE AMERICA TODAY? MEXICO, US, CANADA, CUBA, VENEZUELA ETC.

Can AUSTRALIAN ABORIGINES CLAIM THE WHOLE AUSTRALIA TODAY?

The TIBETANS discovered TIBET, so based on your logic, CHINA should surrender TIBET TO THEM?

Also, EFFECTIVE JURISDICTION, an International Law should be DEMONSTRATED.

It is very obvious that the FILIPINOS are demonstrating EFFECTIVE JURISDICTION of the PHILIPPINES over the AETAS/NEGRITOS.

Again SEE U AT THE COURT CHINA hahaha!
