Let me get this straight..

A woman had a glass light fitting land on her face during sex in a hotel room (I'm 'guessing' because of the 'vibrations' from the 'pounding'), injuring her nose and mouth... and for some very strange reason that means she should be given money???

WHY?

Can I sue if:
I trip over a gutter and scrape my palms?
Jump in front of a car and get hit?
Trip over carpet in a hotel and hurt my ankle?
Hurt my hand on a Macdonalds table?
Trip over a chair at a cafe and hurt my knee?
Hurt my mouth with a restaurants fork while eating?
Burn myself in a hotel room shower?
Paper cut myself with a stores receipt?

If not, can someone tell me why?

Yes - if legal principles can be determined - there must be harm, there must be causation and there must be proximity (remoteness of damage), then there must be reasonable foreseeability on the part of the defendant. Example: complainants have sued councils for injuries sustained when tripping on uneven pavement.

I could understand if she took action against the motel for installing a faulty lighting fixture or failing to maintain equipment if that was the case, but workers compensation .... that somehow doesn't seem right and I would think that giving details of her personal activities would be extremely embarrassing.

No, three male judges upheld the decision of Judge John Nicholas who rejected the findings of the Tribunal in favour of the applicant.

It sounds pretty weird but these days I suppose sex worker is considered to be a legitimate occupation and if she or her employer had been paying workers compensation insurance, a claim would be fair, literally injured on the job.[excuse the pun]. Next thing, husband and wife will have to take out personal risk policies in case of bedroom accidents, like tripping over discarded clothing on the floor, the mind boggles at where this could go.
