Construction employers should be allowed to discriminate against foreigners: CFMEU

The powerful Construction Forestry Mining and Energy Union (CFMEU) is demanding that employers be granted the right to discriminate in favour of Australian permanent residents over temporary foreign workers when making redundancies, according to The Australian.

The union has demanded that the federal Labor government allow employers to eliminate temporary foreign workers on 457 visas as part of redundancies before permanent Australian residents are let go from their jobs, the report added.

The push comes despite legal advice to the Labor government that laying off 457 visa holders first could breach some state anti-discrimination laws.

“Our view is that the Commonwealth and state anti-discrimination laws should explicitly provide that discrimination by employers in favour of Australian citizens and permanent residents not be prohibited by the consolidation legislation,” the union said in a submission to Labor's plans to consolidation discrimination laws from five acts to one, according to The Australian.

However, the union's push received a harsh review from the resources sector, with the Australian Mines and Metals Association (AMMA) labelling the proposal as “extraordinary” and saying such a move would be at odds with Australian values.

“The Australian mining industry needs a diverse range of employee skills and experience to be internationally competitive. Migrant workers play a small but important role in securing future projects and the widespread employment, social and economic opportunities these create for all Australians,” AMMA executive director of industry Scott Barklamb said, according to The Australian.“The industry fundamentally rejects the creation of an underclass of workers based on where people come from.”

Yep, 457 visa holders have been the target of many parties and the fee just for applying has increased by over 25%(see the post here on it http://www.457visacompared.com.au )

My problem is with employers giving preference to visa holders , over Australian citizens. The visas are valid in some instances , but how can an Australian ctizen be layed off , and a 457 visa holder be kept in a job ?.....it sounds dodgy to me, and sets a dangerous precedent for employers to use cheap immigrant labour before employing Australians......

My uncle does training and assessment for chainsaw operators, recently he trained and gave tickets to 8 mongolian timber cutters to work in the Mitchell area of QLD cutting cyprus pine, the pretext of the employer that had sponsored them was that they couldn't get australian timber cutters. After two years continuous service these blokes would be eligible to apply for a PRV. Who is screwing australia, the government or big business or are the two one.

I see it as you do. In the national interest, all other things being equal established Australians should have preference over 457s for job security.

Even among Australian citizens when companies "downsize" it's often a case of "Last on, first off", regardless of color or qualification. 457s should not expect more job security that that.

The question then arises: suppose 457s do in fact get put off ... then what? Do they get sent back home ... or do they switch to burdening the public purse via CentreLink?

I suppose it's one consolation but no, 457 visa holders are not eligible for family assistance or centrelink benefits until they hold a PR visa.

Speaking on ABC News 24, Mr Bowen said the government needed to send “a very crisp and clear message” to people who might look to come to Australia as economic migrants, particularly from Sri Lanka.

“If you are coming as an economic migrant and you are counting on the fact that while your refugee claim is being processed you can work and send money home - and it can be in your economic best interest to be in Australia - then that's not possible, that is why we've done it,” Mr Bowen said.

But he left open the prospect of allowing asylum-seekers found to be legitimate refugees to work, while they wait about five years for a permanent visa under the “no advantage” test.

Mr Bowen said he wanted to “make sure they have appropriate support and care and where appropriate they have some mechanism in place to be able to support themselves, we'll do that overtime.”

The article claims that employers are favouring 457 holders because they have a fear of the ant-discrimination laws.....as the union says , the jobs of Australians should be more important than any anti-discrimination laws.....this is another backdoor attempt by the "Gina Rinehardts" to fill their mines with overseas workers ,at the expense of Australians.....another "thin edge of the wedge"...I think there's no doubt, they are trying to accomodate the wishes of Chinese and Indian big $$$ investors in our mining sector....the CMFEU has thwarted a few of these attempts in the past , and should be fully supported on this one ,as well.
