He is well within his rights to do so.
There is a little thing called copy right laws. You cannot use someone else's material in a public venue or via broadcast (especially for personal gain or profit) without getting their permission and/or paying royalties for it.
Tom Petty was well within his right to Sue Michelle Bachmann for theft of his material. However, he didn't do that... he merely asked her to stop using his song.
That was a very polite and rational way to have dealt with the unauthorized use of his song... that is unless you are some kind of anti-American communist who doesn't believe in private/intellectual property rights...

ditto, at least he was courteous and asked her. unlike that dick Jackson Browne who full on filed a lawsuit after McCain used one of his songs.
