The article does a good job of outlining the community-members' issues and concerns, but I think it portrays the Planning Commission as acting without any reasonable rationale. I think the community and the This Week readership are better served if they understand that the Planning Commission made its decision based on a very thorough evaluation of the facts and within very narrow confines of the law. The article fails to mention that Federal and FCC regulations limit the ability of local planning commissions to prevent mobile wireless carriers from installing antenna to provide coverage. The legal counsel for the Village of New Albany prepared a very thoughtful and thorough memorandum that outlined the constraints for the Planning Commission. The article omits the constraints under which the Commission must evaluate and decide on telecommunication related items.

I think it is important that the community know that their volunteer commissioners are not acting simply out of their own view of what is best for New Albany. Community input and opinion matters a great deal and has significant weight in the decision-making process. That said, community input is one of many factors to be incorporated in the decision. Other factors like planning code language, staff assessment, federal guidelines / laws, environmental impact, and applicant's argument will also guide the Commission's decisions.
