I have to wonder how the DA can proceed when the lead investigator for the Santa Cruz Police Dept., Det. David Gunter, has been ruled "a discredited witness" by Judge Paul Burdick. Another serious problem for the prosecution is that officers testified that protesters weren't given a verbal warning to leave the building until 7:30PM or 8PM and after dark. This means any photo or video of protestors taken in the daytime can't be used as evidence since they had not yet been warned to leave---a requirement for the section of the code under which they've been charged. And if the DA can't prove trespassing, she can't prove vandalism. Her whole theory for charging the defendants with vandalism is that "they entered the building." Of course, in my own case, I didn't even do that.
