The official hearing date to determine whether Wade can go forward with his late creditor claim or not will be October 1st.

This was possibly due to Jimmy Safechuck joining the case on April 12th (not May as fans claimed).

Apparently, if Radar Online was to be believed, MJ's camp tried to get this case stopped or halted in May. Whatever the case, the court didn't agree.

Here's the ambitious (and sometimes hilarious) attempts by MJ's camp and estate to dismiss the suit:

Too bad for MJ's people that the judge has decided to not only prolong this but give Wade and Jimmy enough time to build their case.

That was very helpful.

At first, I thought that maybe the estate did have the case dismissed. I am disappointed that Wade and Jimmy have to wait even longer to find out if they can move forward.

To be fair, I don't know if we were ever sure about the dates but it's clear the delay was due to them wondering what date they could agree on.

It is like when Wacko was still alive. It is still sticking to him like glue. I am hoping that the estate's lawyers are not finding loopholes to get the case dismissed. I am sure that the greedy Jacksons do not want it to go to trial on the fact that the clown is dead. This was their second delay. Very disappointing.

That's good news that they haven't rejected Wade's or Jimmy's case. I was starting to wonder whether the US was living in the Stone Age by putting a time limit on whether or not sex abuse victims can seek justice and compensation.

It wasn't. In fact I don't even think the court had set the real date for the hearing. What can be confirmed is MJ's estate did try to dismiss the case altogether (no hearing, no nothing) and the judge said "no, we're not gonna dismiss it, we're going to set the hearing on October 1st." Lol that's what I took from it.

I forget where exacty I've read it. But I did see it somewhere. Donna was very upset about it because it fell on the fifth anniversary of the clown's death. So obviously, I was not just seeing things. Anyway, the date of the hearing has been postponed again.

One of the ways the estate is trying to wriggle out of it is by mentioning the age of 26 is the cut-off point. Another means is to point out the entity cannot be tried in civil court because it is the individual Wade said abused him.

Even if the defense succeeded in stopping Wade and James, it doesn't make any difference. Michael was a child molester.

And yes, the phrase. "...timely cause of action", is indeed about statutory limits. The defendant is merely trying to claim the evidence is old and not based on the claim as a new discovery. Fortunately precedence of law clearly outlines the time for acting on a discovery starts when the discovery happens and not on the time when the actual event happens.

Bad news for the Estate. Standard legal maneuvering is all this is.

Exactly. That is why the estate's lawyers want the case dismissed. Their argument is that Wacko is dead and the statue of limitations have expired. From what I gather, they desire to pressure Wade Robson and Jimmy Safechuck to give up on their civil lawsuit based on the fact that Wacko is not here to defend himself.

The "timely-cause-of-action " argument is telling. It shows the defense is well aware Michael did molest children.
