Personally, I paid no attention to the trial when it was in progress, so there really was no "scandal." Martha Stewart was not an "insider" and she had no "insider information." "Insider trading scandal" is completely a media- created fiction.

Two months before the stock sale, Ms. Stewart accepted a tender offer for the ImClone shares from Bristol- Myers, but because the tender offer was over-subscribed, she was left with the remnant 3,928 shares. Ms. Stewart sold 3,928 shares of over 7,000,000 ImClone shares that were traded based on sound investment management principles, and the remnant sale was part of the previously planned divestiture of the stock. This small inconsequential sale was perfectly legal under the securities laws, and she owed no one any explanation for the sale.

Not a single word spoken by Martha Stewart or any of the federal agents was recorded in a sworn testimony or verbatim transcript. No evidence existed that Ms. Stewart did anything wrong; there was an evidentiary void in the bogus charges against her. A big-time trumped-up charge was thrown out at trial, and all the other charges were just as bogus.

In my opinion Martha Stewart didn't do anything worse than other holders of multi-million dollar portfolios. They are all (I've been told by someone in the stockmarket trading industry) doing this - buying or selling on insider information. Brokers cater to their wealthy clients, let's face it - the whole world does. When caught? Lie, lie, lie...it is the tour de force in today's life!
