Fault or no-fault...does it really matter? My husband's ex-wife cheated on him and he was so distraught he just gave her the divorce she wanted. They used the trusty "abandonment" reason (meaning HE was the one the abandoned HER according to the divorce decree - what a joke!!) Because family kangaroo courts are SO in favor of the mom, he gets the traditional 4 days of visitation a month (big deal!) For this "generous" time with his kids, he gets 42% of his paycheck stolen from him for an enormous amount of child support, which no one even makes sure is used for the children it was intended. She bragged to me the other day how she bought most of the kids back to school clothes in the Good-Will store. Meanwhile...her and her new husband live in a half-million dollar house on the water, MY husband is subsidizing their lifestyle, and without me to support him, he would NEVER be able to support himself. How is this justified?? Now...my question is where exactly is all this money that he pays her going? If no one's going to make sure it goes to the kids, then let's just call it alimoney and be done with it because that's OBVIOUSLY what it is. She can use it for anything she wants and no one says a word. THIS is what Newsday needs to be doing a story on. The thieving scumbags who take innocent people to the cleaners and say that it's "in the best interests of the children". YEA RIGHT!!!!

Is there a time limit on your word? How long does your honor last? 40 Years or a lifetime? If you can't handle it - don't get married, don't have children. That's your option.

What the heck does a time limit on MY word or how long MY honor lasts have anything to do with me just stating the fact that the vow was written when life expectancy was different.

In reading the post of the attorney who bills herself as one of the "largest", though in 15 years I have never heard of her...it is clear, she is not familiar with highly contested divorce actions.

Divorce Actions which are contested generally are so because one of the parties is unreasonable...one can not settle a case if the other party has a "winner take all" mentality. It is in those instances where grounds are vitally important.

In reading these posts it is very clear that the litigants did not get good advice. Had the 2nd wife husband not given custody of his children to the wife who cheated on him, she would be paying him child support. They would not be "subsidizing' her rich life with the boyfriend. Wanna bet the 1st wife didn't have ground for divorce...so why did he agree to divorce her if he knew he would be paying such a large percentage of his salary? BECAUSE HIS COUNSEL DID NOT TELL HIM he had a choice.

Sit in on some contested divorces and see what the theme is...one unreasonable spouse and the lawyers/judges trying to force a settlement even though the wronged party will be living in poverty.

Grounds must not be passed in NY.
