There are 168 comments on the News Journal story from Jan 17, 2010, titled Fired for being gay? It's legal in 29 states. In it, News Journal reports that:

After a 15-year fight, gay rights' groups believe 2010 will be the year they persuade Congress to pass a landmark law protecting workers from being fired or denied jobs or promotions because of their sexual orientation.

Our federal government can't get a budget together in a reasonable fashion but gays want to waste their time with crap like this. Just another cost of gays in society.

I work in HR Management...so I am the one in charge of making sure that the company behaves itself and doesn't discriminate. I personally have a preference for a diverse workforce, so am probably the least likely person to discriminate against anyone.

The sad truth is that most of the states in the U.S. are at-will states, meaning that you can be fired at any time as long as it isn't for a discriminatory reason that is protected under federal or state laws.

Unfortunately, the EEOC does not cover sexual orientation under its protections. They should get with the times and amend it to cover sexual orientation and transgender status in my opinion. Some states do have anti-discrimination legislation in place for sexual orientation; other states do not, but specific cities/municipalities within the state do. The best way to find out if you are covered is to go to www.lambdalegal.org where they do a great job of keeping up with changes in the laws.

I've had to deal with managers who have wanted to fire people simply because of their age/gender/race/sexual orientation...using thinly disguised "performance issues" excuses. It's really discouraging to me to see just how much negativity there is out there towards others.

I guess the main problem with discrimination is that it is sometimes hard to prove unless you have some very willing witnesses and hopefully live in a place where sexual orientation discrimination is illegal. Most managers tend to be more subtle and will try different tactics, such as the infamous "performance issues" excuses. In that case, get all the countering evidence you can (good reviews, kudos emails, etc, etc.) just in case you need it later.

Yeah, I know I'm kind of a traitor to be posting this...lol...but I am pretty sick of companies acting unethically and hope that at least some of this might help someone out there.

Oh, I wonder how you'd feel if there was descrimination against white males? How about Christians? Blondes? Bruinettes? People who's second toes are longer than their big ones? What about people who wear size 9 shoes? Descrimination against homosexuals is just as senseless, and ending it is not a waste of time. "With liberty and justice for all (except people who act out of the norm.)" is that your America? Without red-tape-moral-obligation-view -forcing conservatives in our government, that budget would have come a lot faster. For those who have trouble with the issue in terms of an employers liberty I will break it down:
Firing an employee for failure to perform the job = ok
Firing an employee because you are a bigot of any sort = not ok

I've never seen anyone fired for being gay before but I've seen gays sway in with their man purses here in CA and verbally bully moral hetrosexuals trying to do their job they don't like and then launch false complaints against them to ruin their careers. Seen it enough that I just don't expect moral behavior from immoral people anymore.

You are absolutely right. It's time we got back to morals in this country. I think as an employer of a large chain of stores I have a right to fire any employee I see as counter productive to my ethics and my companies high standards. When married men or women begin to flirt and carry on affairs on my time on my property I have a moral obligation to see that these employees find more suitable employment elsewhere. The same goes for men and women who have children outside of marriage, their poor choice of life styles shouldn't cost me money. Many things in this world have become legal yet they have never been morally right. I say it's time to clean our own houses and our businesses of things that drag down employee moral and productiveness.

I won't say that your race/gender/sexual orientation should have no effect on your employment, infact i get frustrated when i see a 4'7ft female police offier that weights 300lbs, i mean she's very short, weak and unfit, but can't be fired because it's sexist, now personally i believe she should be able to get fired, police officers are ment to serve and protect, what good is an undersized, overweight police officer that has no hope of subduing a criminal, and even less chance of catching a runner, her gender and size and fitness directly effect her job performance, hence she should be able to get fired (Though i believe she should never have even got hired in the first place)

Certain jobs are affected by your gender/race/sexual orientation, just like some are affected by your fitness, your height, size, strnegth, intelligence and appearance, i mean some of these things can't be changed and is not a life choice but it's not illegal to fire/not hire people based on these, but as soon as you fire someone because of their gender/race/sexual orientation you're suddenly a bigot,now for example, if you had to pick between 3 people for a job where race is not a factor, 2 of them were white with no qualifications and one was black with some qualifications and was better suited for the job, but you refused to hire him purely because of his skin colour, then i think that's wrong and should be taken care of by the law.

TL;DR: I believe in freedom of choice, but i also believe as an employer you should be able to hire/fire people based on how suited for the job they are, everything should be taken into account, your race,gender, sexual orientation, intelligence and any other factory that directly affects your work performance, now say firing a car salesman that's doing well purely because he's gay is not ok, now not hiring a female police officer because her gender and stature that woulddirectly effect her work performance should be ok, see where i'm going with this?

Then in college I had a room mate, I didn't even know he was gay till the last day of my freshman year, I had lived and "survived" a year with a gay man who I spent most of my time with. I was not turned gay, he never came on to, didn't wear make up of have a purse. He played football. People are people. Some are good and some are not.
The relgion,sex, color of skin, or anything else about person tells you nothing of their character or disposition. It just tells you their religion, sex, or color of skin.

I believe that peopl like you and mike need professional help, you make the world a hateful place and only breed more hatred. Please try and beware I want to help you and not the gay person you are so happy that got fired.

If more employers were taken to task in civil court with sympathetic jurors;there would be a humanization of the workplace.As it now stands,the workplace is nothing but a god-damn-rat-race?
