HOUSTON -- A hearing was held in downtown Houston in a lawsuit pitting Anna Nicole Smith's mother against her former boyfriend. Virgie Arthur is suing Howard K. Stern and several others for defamation.

The lawsuit claims Stern, his sister and others conspired to dig up "dirt" on Arthur, resulting in the posting of a story on the website TMZ.com alleging Arthur had produced a son by her step-brother.

The lawsuit alleges the story was false.

Arthur's attorney, Neil McCabe, says plaintiffs are seeking millions of dollars in damages.

An attorney for several defendants declined comment as he left the courtroom.

The judge set a future hearing for Dec. 10, as the sides continue to wrangle over the disclosure of emails the plaintiffs consider to be evidence.

A. She is asking for any kind of information
that would lend light that Larry Birkhead that inappropriate,
or in any way to show him as a bad person and not capable of
taking care of the child.

Birkhead.”, is that what it says?

Q. And what kind of stuff is she asking for, specifically?
A. There were pictures of Larry Birkhead with Anna Nicole, where they looked truly out of it, and just totally inebriated. And then there were stories and such, that followed, of Larry Birkhead in his--in his little boy ways, and Rose wanted to collaborate it all to help.
Q. What was the intent behind finding such things? What was going to be done with them?
A. Well, if there was the chance that Howard could stay as--as presumed father in The Bahamas, even though Larry was the DNA father. That if there is enough nonsense on Larry, Howard could have utilized that and--and retained custody. But because it was between--as Rose had to explain later on. it was between Larry and Virgie. So Howard bowed out and let Larry take the child.

Things I'm wondering about:

How long do people have to turn the stuff over in response to the motion to compel in Texas.

What will Rita argue besides the idea that Stern is libel proof. Will the issue of the nannies be brought up? What about the lawsuits filed against some of the witnesses for Rita - the one against Speers and Hatten and the one filed against Shelley/Thompson. There was in injunction in that case that they couldn't turn over stuff to Rita.

Attorney Ogden who represents Bonnie Stern, Art Harris, Rose Turner and Lyndal Harrington asked Judge Tony Lindsey if the judge should make Mr. McCabe show that he really has a case.

To that she replied,“Oh, I think he’s done that”.

It was a two pronged attack. Against Larry and against Virgie. As late as April 10 there are emails showing Rose trying to get stuff on Larry. Then sometime after that but before April 19 Larry turned that story over to TMZ.

Larry Birkhead emerged victorious from a closed courtroom hearing in Nassau, Bahamas on Tuesday, April 10, 2007.

Obviously the FINAL deal was made just after April 10 and it was full steam ahead against Virgie. By May (that chat) Bonnie was saying we have friends on the Calif. Bar. We will get Opri disbarred All along Larry had a deal with TMZ it seems.
