If the Federal Government going to give marital tax breaks and allow social security benefits to spousal survivors, then it already recognizes marriage...Take those benefits away and it doesn't.

Well they already do...But I guess if there were a reason, it would be in support of the family unit. That doesn't mean it needs to discriminate between different 'types' of families.

I know they recognize marriage. My point is they should not be- there should be no special tax status or any of the 1200 or so benefits given to married couples by federal statues. If there should be any special preference it should be to the children- not the couple.

Because marriage is good for society. Married couples are happier, healthier, wealthier, live longer, and are more productive members of society. That more than makes up for the few benefits & tax breaks married couples get.

Gay relationships are pointless and a waste of time so they can never become marriage. If gays realized that they are wasting their time over some delusion they think is love they would never see each other again.

You should tell that to my husband's hetero niece who just got divorced after a lengthy 6 month marriage to her supposed "soulmate" boyfriend she knew all of 2 months before that!

It is a Constitutional Right under Amendment 9.

The Founding Fathers were not idiots. If they truly felt marriage was one man one woman and only for heterosexuals I think they would have made that clear and not even drafted the 9th.

Amendment IX [Non-Enumerated Rights (passed in 1791)]

The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.

I'll be very happy when a future SCOTUS finally rules that the 9th makes marriage a Federal and not a "States" right, that is also covered under the Full Faith and Credit Clause from Article 4 (The States).

There is no reason to amend the Constitution. Marriage is covered under Amendment 9. We just need to finally get a SCOTUS that will stop treating the Constitution the same way most people treat the Bible (Picking and choosing what they like and ignoring the rest).
