Funny, the federal government can't not over throw the 10 amendment, but as so many of the Obama Schemes, the liberals keep puffing away. Gay Marriage is a state rights item. Federal judges are filing the law suits.........in violation of the constitution.

The Tenth Amendment (Amendment X) to the United States Constitution, which is part of the Bill of Rights, was ratified on December 15, 1791.[1] The Tenth Amendment states the Constitution's principle of federalism by providing that powers not granted to the federal government by the Constitution, nor prohibited to the States, are reserved to the States or the people.

Not if the states create irrational and discriminatory laws that fly in the face of the federal Constitution and it's basic protections to citizens.

If conservatives choose to spit on the Constitution in order to promote bigotry, then they should expect lawsuits.

Sorry to break this to you, but the Constitution's guarantee of the individual's right to marry over the Constitution's guarantee of the state's authority to regulate and issue marriage licenses doesn't violate the 10th Amendment. The states are protected from Legislative and Executive federal intrusion into their powers to regulate, not from the overriding right reserved to the people, their right to marry.
