CBS News has learned that two guns found in the area of a recent Mexican drug cartel shootout have been linked to Fast and Furious: One trafficked by a suspect in the case, and the other purchased by a federal agent.


Mexican beauty queen Susana Flores Maria Gamez and four others died in the brutal gun battle between Sinaloa cartel members and the Mexican military in November. CBS News has learned that an FN Herstal pistol recovered near the crime scene in November was originally purchased by an Alcohol, Tobacco and Firearms (ATF) manager who was faulted by the Inspector General in Operation Fast and Furious: George Gillett. Gillett was the Asst. Special Agent in Charge of ATF Phoenix when Fast and Furious began.


The Herstal pistol is nicknamed a "cop-killer" because of its designation as a "weapon of choice" for Mexican drug cartels. CBS News has learned the Inspector General planned to question Gillett today after a hastily-opened inquiry to determine how this agent's personal weapon got into the hands of suspected cartel members.


CBS News spoke to Gillett, who is still employed at ATF. Gillett acknowledged he once owned the weapon in question, but says he sold it in Phoenix sometime last year after advertising it on the Internet. He declined to provide the name of the man who bought it, but says he went "above and beyond" what was required by law to complete the firearms transaction. That included asking the purchaser to fill out a form giving personal information and stating that he was in the U.S. legally; and checking his driver's license, which Gillett said was issued in the U.S.

"I didn't do anything criminal," said Gillett, who calls himself a gun enthusiast. "I've been a gun collector all my life."


He told CBS News that he ran into financial difficulties in recent years and sold some of his firearms. Gillett says the Herstal pistol may have sold for approximately $1,100.


Sen. Charles Grassley (R-Iowa) wrote a letter (PDF) to the Inspector General late today asking for an urgent investigation. Grassley included records from three of Gillett's gun purchases, so-called Form 4473's, and says that Gillett appears to have provided false information on them.


"Lying on a Form 4473 is a felony and can be punished by up to five years in prison," Grassley's letter states. The senator also points out that's the same alleged violation that suspects in ATF's Fast and Furious operation were arrested for. "Jaime Avila, Jr. recently plead guilty to a variety of charges" in Fast and Furious, including "for giving a false address on Form 4473."


Form 4473's require purchasers to list their current residential address. Gillett's gun purchase forms incorrectly list the local ATF Phoenix office and a shopping plaza as his personal residence, according to Grassley's letter.


Gillett did not comment on allegations about the address on the forms.


In a related development, as CBS News reported yesterday, another weapon recovered in the same area after the shootout in which the beauty queen was killed, had been trafficked by Fast and Furious suspect Uriel Patino.

From New York to New Mexico and across the dependent plains, welfare recipients are getting sauced on the public dime. Drunk, besotted, bombed. But while politicians pay lip service to cutting government waste, fraud and abuse, they're doing very little in practice to stop the EBT party excesses. Where's the compassion for taxpayers?

You see the signs everywhere: "We accept EBT." Fast-food restaurants do. Clothing retailers do. Auto repair shops, liquor stores and even sushi joints are joining the club. "EBT" stands for the federal government's electronic benefits transfer card, which is intended to provide poor people with food stamps and cash assistance for basic necessities. The two separate programs were combined into one ATM-like card designed to reduce the "stigma" attached to Nanny State dependency, and -- voila!-- an entirely new method of mooching was born.

If the idea was to eliminate the embarrassment of life on the dole, the social justice crowd succeeded phenomenally. Last weekend, the New York Post blew the lid off scammers who brazenly swiped their EBT cards "inside Hank's Saloon in Brooklyn; the Blue Door Video porn shop in the East Village; The Anchor, a sleek SoHo lounge; the Patriot Saloon in TriBeCa; and Drinks Galore, a liquor distributor in The Bronx." My home state of Colorado has seen similar abuse. Last year, local TV station 9NEWS reported that more than $40,000 was withdrawn from ATMs in metro-area liquor stores despite prohibitions against such spending. Colorado EBT users also splurged at Denver's Elitch Gardens amusement part, Disneyland, Universal Studios in Los Angeles and on the Las Vegas strip.

In New Mexico, Jim Scarantino of Watchdog.org reported that in just a three-month period, EBT cards were used at multiple liquor stores, girly bars, smoke shops and casinos both inside and outside the state. Californians are notorious EBT fraud artists; some $70 million in EBT funds were withdrawn from outside the state's borders over the past several years, including nearly $12 million taken out in Las Vegas. Watchdog.org kept tabs on government workers in Connecticut, Indiana, Iowa and Wisconsin nabbed in EBT fraud rings and schemes.

Several state legislatures have barred EBT spending on these vices, along with tattoo parlors, lottery tickets and cigarettes. Last February, President Obama signed GOP-backed welfare reform measures into law aimed at closing the so-called "strip club loophole" and preventing welfare recipients from blowing their cash benefits on booze, porn and gambling. But that law doesn't go into effect until next year. And many politicians are just shrugging their shoulders, muttering "Whaddya gonna do?"

.... the Romanian AK stands out, both for the popularity it has achieved with the cartels and for the route it has traveled from Romania through the United States to Mexico — a journey made legally even though for years it has actually been illegal to import high-powered, semiautomatic weapons that do not have a “sporting purpose” into the United States.

U.S. gun laws have been interpreted by federal regulators in a way that affords importers a way around the ban. Foreign guns like the Romanian AKs are shipped into the United States stripped of their military features so they can be treated as sporting guns.

The weapons are then modified by an importer with a few U.S.-made parts, declared to be American-made and shipped through wholesalers to local gun dealers for sale with high-capacity magazines, bayonets and the other trimmings of a bargain assault weapon.

'Furious' guns tied to 2010 Juarez massacre, other murders in Mexico

For the first time, Mexican victims of crimes tied to the botched Operation Fast and Furious are being identified, including teenagers killed in a 2010 massacre.

A new report finds dozens of weapons recovered in Mexico have been connected with the ill-fated and ill-conceived anti-gunrunning program. While some Mexican authorities estimate 300 of their citizens have been injured or killed by Fast and Furious guns, little has been known about those weapons south of the U.S. border until now.

Through the Mexican Freedom of Information Act, Spanish-language network Univision and Fox News obtained a list of 100,000 weapons recovered in Mexico in 2009 and 2010. The guns were then compared with the serial numbers of the 2,000 guns sold in Fast and Furious.

Univision identified a total of 57 more previously unreported firearms that were bought by straw purchasers monitored by ATF during Operation Fast and Furious, and then recovered in Mexico in sites related to murders, kidnappings and other actions by Mexican hit men and drug cartels.

In an investigative special that aired Sunday, Univision revealed one such massacre that was later found to be linked with Fast and Furious.

It happened in January 2010 in Juarez, Mexico, where cartel members burst into a home killing 16 people -- mostly teenagers -- at a birthday party. While the gunmen were targeting members of a rival gang attending that party, some of the victims were innocent bystanders.

Family members of those killed have appeared before the Mexican government demanding to know what happened.

"They are waiting for an answer," said Gerardo Reyes, head of Univision's investigative unit. "They want to know what happened. And why they didn't stop these guns from leaving the U.S. and ending up in these crimes?"

"They feel helpless," added Reyes. "They don't know what to do. We interviewed one of them and they said ...'Who's going to pay for this?'"

It might end up being the U.S. government, should the family of Brian Terry prevail in its wrongful death claim. Terry is the U.S. Border Patrol agent killed in December 2010 in the Arizona desert, and whose murder scene contained weapons linked to Fast and Furious.

"The people can go and sue in the United States with support of American lawyers and that will be a very interesting development certainly," said former Mexican prosecutor Samuel Gonzalez.

The report also reveals the botched operation may have played a role in a 2009 massacre, where 18 young men were killed at a rehabilitation center also in Juarez. The massacre was reportedly ordered and carried out by Mexican hit men.

According to a Mexican Army document obtained by Univision, three of the high-caliber weapons used in the attack were linked to a gun-tracing operation run by the ATF. The partial transcript obtained by Fox News did not specify whether this was Operation Fast and Furious.

The Fast and Furious program caught the attention of Congress and the rest of the country after weapons from the operation were found at Terry's murder scene.

One Justice Department official resigned and another retired after an inspector general report on the probe faulted multiple agencies for letting it get out of hand. Fourteen officials were forwarded for possible disciplinary action.

Update: A spokesperson for the Mexican Embassy in Washington, D.C., said the embassy maintains its position that it had no knowledge of Fast and Furious until the U.S. operation was made public. It also abides by previous statements of the Mexican Federal Attorney General's Office that it was investigating the allegations. According to U.S. lawmakers who investigated Fast and Furious, 150 people in Mexico were victims of weapons tied to the ATF's operation; however, details for most of those 150 people were not provided. Hundreds of F&F weapons are still out there.

Univision TV aired an investigative special last night on Operation Fast and Furious. Citing a Mexican army document, the special presented by Univision anchor Jorge Ramos, alleged that weapons linked to the failed operation of the Bureau of Alcohol, Tobacco, Firearms and Explosives, were used in the 2010 Salvarcar neighborhood massacre in Juarez. Teenagers were celebrating a birthday party when a group of armed men showed up and began firing at them without warning. More than a dozen kids were killed and about as many others wounded.

NYC has set a new record in a low rate of homicide. but a limousine liberal enabler judge just put a stop to the NYPD's successful stop and frisk program. i'm wondering if she is also against "random searchs of large pocketbooks and other large containers" that are a normal part of everyday life in NYC. and will she suspend the use of metal detectors outside her courtroom? how about screening and patting down old people at the airports?

of course where she lives, she and her neighbors don't worry about drive-by shootings or mothers shot in hallways while trying to protect their kids from gang shootouts EVERY SINGLE DAY.

Reliable and powerful, and a bargain at about $500 each, the Romanian-made gun, a semiautomatic version of the iconic Kalashnikov assault weapon, had become popular with the drug cartels in Mexico.

Galloway, who eventually pleaded guilty to a forgery charge and became a cooperating prosecution witness in a broader case, testified that he agreed to act as the purchaser of the Romanian AKs on behalf of a co-worker’s brother, who was trafficking weapons south of the border. Just for doing the paperwork, he earned $100 per rifle.

Four months later, one of the same guns that Galloway signed for surfaced in a safe house used by the Beltrán Leyva drug cartel in northwest Mexico. The discovery followed a deadly shootout between federal agents and drug dealers in Culiacán, the capital of the Pacific state of Sinaloa. Eight police officers were killed.

Only right whiners would be so f*cking stupid to think that if a drug gang member did not obtain his gun through Fast & Furious that he would be unarmed.

100K guns smuggled into Mexico the past 5 years & it is all the fault of the 2k that made it through Fast & Furious.

It is a viable method of stopping smuggling operations by allowing some to pass & try to track where they go.

It was a risk.

The mother of three is among many people calling on school officials to keep up the police presence at schools in Newtown, which has had two officers at each of its schools since a gunman killed 20 children and six women inside the Sandy Hook Elementary School on Dec. 14.

"I think we're all just shaken to the core," said Findley, whose children all attend schools other than Sandy Hook. "I think it made it possible for the people who were maybe wavering about sending their kids to school to actually be able to do it."

The housing market problem was caused by corporations (ie... capitalism). They ignored their own standards and got greedy. What you called "warned" should have been more of new regs against the banks and loan makers.
The deficit is a large part a result of bushie's administration. And as far as I'm concerned, a way for Obama to counter flood a sinking ship he inherited. Even McCain thought the economy was fine the same day the stock market tanked another 500+ points.
The tarp mess wasn't as bad as it could have been. I'm not much of a supporter, but I think it was necessary. My biggest problem is they didn't put stronger provisos on those companies that took money.
I agree that the housing market collapse was underpinned by greed. For years before the collapse, I had said greed would be our undoing. But I had also hoped the silver lining would be a wake-up call and the nation rethinking its priorities. It would seem the pendulum swung too far the other way.

But you must ask yourself again and again and again who most rejected any attempt to prevent the housing market crisis in Congress for years.

Greed played a part in politicians refusing to do anything to prevent it as well. An unpleasant but crucial fact is that 7 out of the top 10 politicians were democrats and, then, Senator Obama was #3 on Fannie and Freddie's payroll.

Unless and until you can acknowledge this as a crucial factor, you will always be in denial.

Both Republicans and Democrats share part of the blame, but it is Democrats who are most in denial.

The idea of the assault like rifle ban & the ban on high capacity magazines is not to stop all crime. The idea is to make these attacks far less lethal.
