Because the US Supreme Court ruled in the Wong Kim Ark case that the meaning of Natural Born citizen comes from the common law and refers to the place of birth. It does not come from Vattel, whose word “indigines” was not even translated as “Natural Born Citizen” in any English-language translation of Vattel until ten years after the Constitution was written, but the phrase Natural Born had been used in the common law for 300 years before the Constitution was written, and by far most of the writers of the Constitution were lawyers and justices. And I am saying that there is overwhelming evidence that the writers of the US Constitution used the term Natural Born the way that it was used in the common law in many of their writings, meaning to refer to the place of birth, and there is not a single example in which any one of them uses it to refer to parents. And the Federalist Papers refers to the common law about twenty times, and not to Vattel at all. |

It is not at all likely UNLESS THEY HAD TOLD US considering that the Natural Born phrase from the common law was used commonly as discussed above, and since there is no example of the writers of the Constitution ever saying that they took the term Natural Born Citizen from Vattel. And John Jay, who used the term, was a lawyer and justice (first justice of the US Supreme Court) who was an expert in the common law, and who wrote the common law into the first constitution of the state of New York in 1777. In any case, the term comes from the common law, as the US Supreme Court ruled in the Wong Kim Ark case, and as such conservative legal scholars as Edwin Meese, Ronald Reagan’s attorney general, and senators Hatch and Graham and former senator Fred Thompson all agree. And so does nine state and federal courts (and not one ruled for the birther theory), and so does every single member of the US Electoral College (not one of whose members changed her or his vote from Obama to Romney or from Obama to McCain out of the legal theory that two citizen parents are required). Oh, and by the way, the Minor v. Happersett case did not rule that two citizen parents are required EITHER.(And the Wong Kim Ark ruling was after Minor v. Happersett, so it is the key ruling in any case.) |
