With the 2012 presidential election before us, the country is again caught up in debating national security issues, our ongoing wars and the threat of terrorism. There is one related subject, however, that is rarely mentioned: civil liberties.

Protecting individual rights and liberties — apart from the right to be tax-free — seems barely relevant to candidates or voters. One man is primarily responsible for the disappearance of civil liberties from the national debate, and he is Barack Obama. While many are reluctant to admit it, Obama has proved a disaster not just for specific civil liberties but the civil liberties cause in the United States.

Under the current Obama policy, the President effectively promises to be careful in the selection of assassination targets.

It is a decision left entirely to him and his designated subordinates.

It runs contrary to constitutional guarantees protecting persons accused of crimes.

The President can claim that the location of such individuals abroad is the key distinction since courts limit the application of constitutional protections and limitations outside of our border.


Yet, we have already seen that the Justice Department argues that other rights can be similarly waived in the country like due process rights and the right to counsel for anyone accused being an enemy combatants. The enemy combatant policy and cases largely eradicated the domestic/foreign distinction used in the past.

Obama Assassinates US Citizens: cont.


It is not simply a question of whether a president can order such a killing of a citizen but the circumstances under which such an order can be given.

Obama put al-Aulaqi on a hit list many months ago. There is no process, however, to secure any judicial review or to satisfy any showing despite over a year of such targeting.

These questions remain unanswered because the Obama Administration has been successful in blocking public interest lawsuits seeking judicial review of his assassination list.

Previously, the Administration succeeded with an almost mocking argument that al-Aulaqi’s family could not file a lawsuit seeking review of the power to assassinate because al-Aulaqi himself should appear to ask for review. Thus, after saying that it would kill al-Aulaqi on sight, the Justice Department insisted that he should walk into a clerk’s office and ask for declaratory judgment. Even if his family were to sue for wrongful death, the Administration would likely use the military and state secrets privilege to block the lawsuit. Thus, the President has the authority to not simply kill citizens but to decided whether they can sue him for the act.

Even if a president has this authority, the existence of the power to kill citizens without any check or balance runs against the grain of the constitutional system.

Our Divisive President


Barack Obama promised a new era of post-partisanship. In office, he's played racial politics and further split the country along class and party lines.

During the election campaign, Barack Obama sought to appeal to the best instincts of the electorate, to a post-partisan sentiment that he said would reinvigorate our democracy. He ran on a platform of reconciliation—of getting beyond "old labels" of right and left, red and blue states, and forging compromises based on shared values.

President Obama's Inaugural was a hopeful day, with an estimated 1.8 million people on the National Mall celebrating the election of America's first African-American president. The level of enthusiasm, the anticipation and the promise of something better could not have been more palpable.

And yet, it has not been realized. Not at all.

Rather than being a unifier, Mr. Obama has divided America on the basis of race, class and partisanship. Moreover, his cynical approach to governance has encouraged his allies to pursue a similar strategy of racially divisive politics on his behalf.

The first hint that as president Mr. Obama would be willing to interject race into the political dialogue came last July, when he jumped to conclusions about the confrontation between Harvard Prof. Henry Louis "Skip" Gates and the Cambridge police.

During a press conference, the president said that the "Cambridge police acted stupidly," and he went on to link the arrest with the "long history in this country of African-Americans and Latinos being stopped by law enforcement disproportionately."

In truth, the Gates incident appears to have had nothing to do with race—a Cambridge review committee that investigated the incident ruled on June 30 that there was fault on both sides.

Sen. Jon Kyl (R., Ariz.) has said the president told him in a closed-door meeting that he would not move to secure the border with Mexico unless and until Congress reached a breakthrough on comprehensive immigration reform. That's another indication Mr. Obama is willing to continue to play politics with hot-button issues.

Add in the lawsuit against the Arizona immigration law and it's clear the Obama administration is willing to run the risk of dividing the American people along racial and ethnic lines to mobilize its supporters—particularly Hispanic voters, whose backing it needs in the fall midterm elections and beyond.

As the Washington Post reported last week, two top White House strategists, speaking on condition of anonymity, have indicated that "the White House plans to use the immigration debate to punish the GOP and aggressively seek the Latino vote in 2012."

No Class & No Jobs Obama:


During the 2008 presidential campaign, Mr. Obama's campaign emphasized repeatedly that his minister, the Rev. Jeremiah Wright, was being unfairly stereotyped because of racially incendiary sound bites that allegedly did not reflect the totality of his views. In the Gates incident and others, Mr. Obama has resorted to similar forms of stereotyping.

Even the former head of the Civil Rights Commission, Mary Frances Berry, acknowledged that the Obama administration has taken to polarizing America around the issue of race as a means of diverting attention away from other issues, saying: "the charge of racism is proving to be an effective strategy for Democrats.... Having one's opponent rebut charges of racism is far better than discussing joblessness."

The president had a unique opportunity to focus on overarching issues of importance to whites and blacks. He has failed to address the critical challenges. He has not used his bully pulpit to emphasize the importance of racial unity and the common interest of poor whites and blacks who need training, job opportunities, and the possibility of realizing the American Dream. He hasn't done enough to address youth unemployment—which in the white community is 23.2% and in the black community is 39.9%.

Obama the Divider



Mr. Obama has also cynically divided the country on class lines. He has taken to playing the populist card time and time again. He bashes Wall Street and insurance companies whenever convenient to advance his programs, yet he has been eager to accept campaign contributions and negotiate with these very same banks and corporations behind closed doors in order to advance his political agenda.

Finally, President Obama also exacerbated partisan division, and he has made it clear that he intends to demonize the Republicans and former President George W. Bush in the fall campaign. In April, the Democratic National Committee released a video in which the president directly addressed his divide-and-conquer campaign strategy, with an appeal to: "young people, African-Americans, Latinos, and women who powered our victory in 2008 [to] stand together once again."

President Obama's divisive approach to governance has weakened us as a people and paralyzed our political culture. Meanwhile, the Republican leadership has failed to put forth an agenda that is more positive, unifying or inclusive. We are stronger when we debate issues and purpose, and we are all weaker when we divide by race and class. We will pay a price for this type of politics.

Dodd Blames Obama Administration for AIG Bonus Amendment

March 19 (Bloomberg)-- Senate Banking Committee Chairman Christopher Dodd said the Obama administration asked him to insert a provision in last month’s $787 billion economic- stimulus legislation that had the effect of authorizing American International Group Inc.’s bonuses.

Dodd, a Connecticut Democrat, said yesterday he agreed to modify restrictions on executive pay at companies receiving taxpayer assistance to exempt bonuses already agreed upon in contracts. He said he did so without realizing the change would benefit AIG, whose recent $165 million payment to employees has sparked a public furor.

Dodd said he had wanted to limit executive compensation at companies that got money from the government’s financial-rescue fund. AIG has received $173 billion in bailout money. His provision was changed as the stimulus legislation was negotiated between the Democrat House and Democrat Senate.

Obama White House Bails Out ‘Clinton’s Favorite Bank’ Through Goldman Sachs, Citigroup, GE

The Ranking Republican on the Financial Services Committee last month asked the Obama Administration to explain its role in the bailout of Chicago-based ShoreBank, a lending institution favored by the community organizing and green job creating crowds. Hundreds of similar-sized others were allowed to fail, but several “too big to fail” banks (who survived thanks to TARP money) were reportedly pressured into a joint effort to rescue ShoreBank. Bachus sent the president a letter, then issued a press release:

Bachus and Oversight and Investigations Subcommittee Ranking Member Judy Biggert demanded to know who in the Administration was involved in orchestrating capital contributions totaling approximately $150 million by some of the nation’s largest banks, including Goldman Sachs and Citigroup (also GE Capital, JP Morgan, and others), so that ShoreBank could qualify for $75 million in TARP funding.

“When you have the Obama Administration picking winners and losers, their political friends get bailed out while taxpayers and those less politically connected get the short end of the stick,” Bachus said.

In addition to requesting responses as to who in the Administration was involved, Bachus and Biggert called on the White House to release all records of communication—including emails, phone logs and meeting records—related to the ShoreBank negotiations that exist between the Administration and representatives of ShoreBank, and executives of the banks involved in the bailout….

“There is no way a bank without ShoreBank’s political connections would receive this kind of attention, and these actions fully make the case as to why the government should refrain from subjective, ad-hoc bailout practices,” Bachus continued.

The Central Illinois 9/12 Project has outlined extensively those connections and highlighted ShoreBank employees’ political donations to Obama, as well as his promotion (as a U.S. Senator) of the bank’s microlending efforts in far away places such as Kenya. But the political nurturing and blossoming of the little community bank with a big heart goes back to the Clinton Administration – when Bachus first became intimately familiar with them.

President Obama attacked Romney for not immediately endorsing the Lilly Ledbetter Fair Pay Restoration Act, which is very controversial and actually promotes lawsuits more than it protects women. Obama is always railing about his support of women, especially now that he has invented the Republican war against women, but he doesn’t always follow his own alleged beliefs.

Free Beacon: Female employees in the Obama White House make considerably less than their male colleagues, records show.

According to the 2011 annual report on White House staff, female employees earned a median annual salary of $60,000, which was about 18 percent less than the median salary for male employees ($71,000).

Obama, How Could You Sign This Police-State NDAA Bill?

On New Year's Eve, President Obama signed into law a bill that eliminates one of the fundamental protections of the U.S. Constitution:

The right for people not to be detained indefinitely by the government without being formally convicted of crimes.

This erosion of the Constitution, which came in the form of new language in the annual National Defense Authorization Act (NDAA), allows the government to hold anyone suspected of being associated with terrorism indefinitely, without any form of due process.

No indictment.

No judge or jury.

No evidence.

No trial.

Just an indefinite jail sentence.

In other words:

If someone in the government suspects that you're somehow associated with terrorism, you can be jailed indefinitely in a military prison.


To be clear: This bill isn't just tough on terrorism. It overturns a key part of the Constitution. And it presumes that those who serve in the government and military are always omniscient and perfect and will always use their power for the good of all citizens.

And that presumption, as everyone who has ever watched our government in action knows, is laughable.

Will America be transformed into a brutal police-state by this one bill? Probably not. But the constitutional protections and other checks-and-balances that separate democracies from authoritarian states are rarely eliminated in one fell swoop.
