If the employer knew that they were hiring an illegal then they should pay for on the job injuries but if the job was obtained with fake or stolen I.D. tough. Either way the illegal alien should be deported.

Connecticut judges did this years ago. It wasn't comp, but overtime for illegals who were working on expanding the University of Connecticut.

Ironically this is correct if certain circumstances were met.
Even though the illegal alien used false papers to gain employment the employer likely paid into the workers comp system for the worker so despite the many crimes committed by the illegal alien it is a sad twist that the illegal alien gets to collect workers comp.

the courts need to find all cases like this as malarkey, illegal aliens are not supposed to be here so the courts should see them all as nonexisting if using fake papers.

Should be treated like an illegal contract and thereby voided.

My Brother employs many illegals aliens in Nevada on green cards. These users scream the race card every time they think they can. He has seen them use workman comp. so many times it would make you sick. He has seen them fake injury and work construction under the table all the while screwing Workers Comp. The have no morals.... none.

very true, if the employers pay into workers comp for the workers as much as I hate saying and an accident happens workers comp has to pay. What should be done is workers comp system should make sure the employer HIRES ONLY LEGAL HELP. I guess a law would have to be introduced.

No one in his right mind admits to KNOWINGLY hiring illegals.

That said, a lot of us hire folks who are PROBABLY illegal, but we don't ask, and they don't tell (because we don't have to). That's how business gets done in much of the SW USA.

But I have never KNOWINGLY hired an illegal. For all I know, they were all legal. Yeah, they were all legal. Sure they were...

Were they illegal? I don't know, and I don't care.

Did they do a good job for the price? Yes, they usually did, and those who didn't never worked for me again.

There is this little deli and bakery in Austin called Texas French Bread. Very trendy and overpriced place for hipsters spending their parents money to go. Used to be on S Congress but moved a little farther north now to be nearer to the university.
ICE busted the place a few years back for knowingly hiring illegal aliens. Their entire staff, minus the owner were illegals and many had been there for almost 10 years.
The owner claimed he did not know they were illegal aliens and they all had SS#s and such.
Social Security had for years been sending him no match letters for his employees and he admittedly ignored them all.
Somehow he avoided fine and prison and still operates, minus his illegal aliens who were all deported.
It is sad that it took years for this to come to the attention of ICE.
I was at a Mcdonalds last year and a manager was in the next booth with three males in uniform and the job interview was talking place in Spanglish, which as a true Spanish speaking Gringo I understand. They were illegal aliens and one admitted to not having the $50 for a fake # from the local flea market. Manager said no problem he is still hired and can get it later.
I did to want to make a scene so I called my brother in law who works for ICE and told him. Three days later the manager, the three new hires, and 8 others were all gone. ICE came and found 11 illegal aliens there working and the manager was fired by the owner of the franchise.
Now when I go there the staff up front at least speak great English and are either black or white/non hispanic ethnicity. I have also not had a mistake on my orders since then either, which was a chronic issue before.

DING DING DING. Damn, my BS meter is going off.

I'm going to call "BS" on your story for a number of reasons. First off, no government agency, including ICE, does anything in three days, let alone on a "tip." A government agency can't organize an office birthday party in 3 days, let alone round up people and deport them.

You could go to a border patrol or ICE station and tell the guys inside that there were illegals 100 yards from the building, dripping wet from crossing the Rio Grande, and they probably wouldn't drop their donuts and go out into the Texas heat to check it out.

But the biggest reason I'm going to call BS- How do you know the manager and others were fired, just because they weren't there the next time you went in (news flash, genius, McDonald's workers don't always work regular hours). Did you hang out in the parking lot for days, playing pocket pool, waiting to see if any of them drove up?

The franchise transferred the manager and brought in another, I asked the one on duty next time I went there and she told me this.
ICE nnormally does little in 3 days but when you know someone there they do alot. You tell them there are 100 dripping wet illegals in a given location they probably would do something quick as it is worth their while. one or two they probably would not.
