Tomorrow will be the day that the 9th Circuit Court of Appeals will rule on Prop 8. If they rule that the pro-Prop 8 groups do not have standing to appeal, it may be the end of the road for Prop 8 in the courts, but whatever the outcome, it is likely that this will be going to the US Supreme Court.

Whatever the ruling is.....it will be appealed.

I'm optimistically hopeful that the 9th will uphold Judge Walker's ruling after listening to oral arguments a year ago.....but at the same time cautiously realistic that they could rule against us.......either way.......I believe this is not the end unless the 9th rules that the proponents have no standing......but, I don't believe that will happen.

3 big issues-

1- what will they rule
2- what will be the scope of their ruling
3- will they stay their own ruling pending appeal

In a similar case, SCOTUS has already ruled that proponents don't have federal standing for an appeal. If stare decisis means anything to the 9th Circuit justices, they rule the same way and the entire case will be mooted.

Then the proponents will appeal that ruling to SCOTUS, who will decline to hear the case.

That's my hope.

But there are so many other possibilities. I'm looking forward to tomorrow's rulings. They happen at 8am here in Hawai'i, so I'll be starting my day either very happy or very angry.

I truly don't foresee you being unhappy......I believe standing will be granted, but only because the 9th truly wants to rule on the merits and I don't see them doing anything but upholding Judge Walker's ruling........the only thing that I'm not sure about is whether they stay their own ruling pending a further appeal!!!

Regarding a stay by the Court if they confirm Judge Walker's decision, there already exist thousands of same sec marriages in CA which, of course, were not touched by Prop 8. That fact would make it harder to support the requirements of imminent harm in granting a stay. Or it should.

Regarding the appeal to SCOTUS, if Dick Cheney really loved his daughter he would soon invite Scaliar and Justice Uncle Thomas Clarence for a weekend of beer drinking and shootin'.
