Concealed carry ban in Illinois struck down

A federal appeals court has struck down a ban on carrying concealed weapons in Illinois, the only state where carrying concealed weapons is entirely illegal.

I would not get all excited. Illinois can simply adopt a "may issue" style system along the lines of New York's system which basically prohibits concealed carry except for those with money, power and/or connections. You can have the right in theory but denied in practice. I am sure the Illinois legislature will come up with a system so strict that no one will qualify yet still adhere to the ruling.

Yes, they could, but the Illinois legislature has the votes to block such a restrictive law, and key legislators have already signaled that they will not tolerate such restrictions. Illinois anti-gun rights advocates are over a barrel. The court stayed the decision overturning the law for 180 days, but if the legislature does not pass something then the law is struck down and what Illinois will have is Constitutional Carry: no permits required, no time, place or manner restrictions. The anti-gunners are terrified of this. I would think that they are going to be stroking-out big time as the begin to realize what this ruling means.

Sadly I am a pessimist and seeing how both DC and New York State get away with severe restrictions, I see them as a model for Illinois. Especially with the Chicago delegation being as vocal as they are. So far, the absurdly restrictive DC model has held up in court. Plus if you look at New York State, the city of New York has its own rules independent of the rest of the state. As such, Chicago/Cook County might very well figure out a way to exempt themselves from more liberal statewide regulations.

I am just hoping the folks in Illinois are not getting too giddy right now because politicians have a special talent for destroying rights and the devil will be in what monstrosity the Illinois legislature comes up with all while being harangued by the Chicago delegation. If/until the Supreme Court weighs in, it is all variable.
