This will be an interesting case to watch IF it makes it to court. Odds are the State will want to settle so there is no new precident set. I'm betting on a settlement and everything will stay the same. The OSP has already said their investigation found no problem with the arrest. My problem is that an innocent person was in jail for two days "UNTIL THE TEST RESULTS CAME BACK AND THEY WERE NEGATIVE". That's just wrong. If you are not proven to be intoxicated you should not be held. Cite and release. I don't believe this was abuse of authority BUT there is a problem with the system. Why can't the Sheriff's Office take the Credit Card? They will take cash. There would be no difference. This just looks like a way of guaranteeing a bail bondsman gets his share.
