The only reason why the Coast Guard has such an impressive string of wins in front of the ALJ's is simply because of the fact that the only cases brought forward are slam dunks (e.g. mariner will test positive for illegal drug use or alcohol intoxication). I guess Cummings would prefer that the Coast Guard simply shrug their shoulders when it comes to enforcing safe marine practices. Gotta love lawyers.

How would you like it if your future existence was to be determined by a individual (judge) that is told to always rule for the Coast Guard and who is afraid of losing his job to rule any other way. When this happens there is nothing you can say to disprove my belief that these individuals do not belong in their current positions but belong in jail. "Hats off" to all the Coast Guard menbers who helped after Katrina. They deserve all the respect that they get. These individual are HEROES! When it comes to malfeasance in office and violation of federal judicial laws, those who participate in this activity belong in jail. This activity is a "kick in the balls" to the US Constitution,to the entire judicial system and to every American. I very much look forward to your response to this post. I call it like I see it. When I think someone is a hero I say it. When I think someone is a criminal I say it. Don't let the actions of the criminals diminish the actions of the heroes. How dare you compare the Coast Guard respone to Katrina to the alleged unscrupulous illegal actions of corrupt ALJs. How would you fell if you were Mr. Christopher Dresser and discovered that you recieved a predetermined verdict of guilt before any evidence was heard. This guy lost his job and hiis life was ruied. What if this was you? I am sue you would feel a little different. All that is needed for corruption to flourish is for honest people to sit by and do nothing. The Coast Guard judicial system need to be dismantled immediately and authority placed in an independent agency ruled by "finders of fact" and not "predetermined verdicts of guilt". Tampering with the judicial system is a serious matter. I believe there is enough evidence presented to remove CALJ Ingolia and ALJ brudzinski from office for gross malfeasance in office. Coast Guard Commander Thad Allen must go also. Who does this man think he is? Despite the efforts of Congress he will not let the current ALJ Coast Guard ALJ system be dismanteled. This sounds like a case of further obstruction of justice. This man should be prosceuted for his actions. I would also like to know who reappointed CALJ Ingolia in October of 2007. Who ever was responsible for this is also guilty of malfeasance. See how corruption spreads. It is just incredible and is further evidence that the current Coast Guard ALJ system needs to be dismantled IMMEDIATELY!!!! Good Luck Congressman Elijah Cummings!!! You will need it with so much obvious corrupt opposition! Offering any opposition to "dismantling the current ALJ system" is a definitive kick in the nuts to the US Constitution, the entire judicial system and every American. This kick in the nuts is followed by a good measure "middle finger" to seal the deal. Anyone opposing the right to a fair and impartial judicial system must go. No exceptions! I am a mariner,and have ALWAYS taken responsibility for my actions. What is so troubling to people like me is the inability for the coast guard to do the same. No one questions the coast guard's marine rescue operations.IT'S THE MARINE INVESTIGATION OFFICE.IT's CORRUPT.IT'S INEPT.It is overrun with cowards who DON'T throughly investigate,but 100% accuse. Their egos are only overshadowed by their incompetence. So Marjorie-----you couldn't be more wrong if you tried. You are totally out in left field guessing on the next fly ball. If Mr. Cummings stays true to his word, he has my vote for president.

this action is long past due Ex judge Fitzpatrick called the articles yellow journalism after the hearings .Judge Fitzpatrick out right commited perjury when testifying in front of congress I have documents that prove Fitzpatrick had no problem involving himself in pro hibited ex parte communications in a case he was hearing he commited this action numerous times throughout the case The CG needs to be relieved of its ALJ asap or the US merchant mariner will disappear

One can only assume Thad Allen wants to keep the exclusive club intact that being the only worlking group of civilians who are under direct military control. Who cares about Katrina now? NO is in worse shape than ever before with crime at an all time high The US merchant marine must be removed from the control of the USCG anyone interested in copies of Judge Fitzpatricks prohibited ex parte communications need only to ask as they will be made available upon request I am amazed the judges can sleep at night knowing they have ruined many a mariners life

The real hero in this corrupt ordeal is Congressman Elijah Cummings. He went above and beyond the call of duty to eliminate this corrupt system. I would vote for him for president in a second. Hopefully he can dismantle the Coast Guard ALJ quickly. The only thing corruption needs to flourish is for good, honest men to do nothing. Thank God Congressman Cummings is not one of these men. He is an honest man who took a stand against corruption. God Bless him. He is a real Hero. ALJ Jeffie Massey is also a hero. She did what need to be done by exposing this corruption. There are also a big list of heels (for the sake of a user friendly word) that appeared in this scandal. Most noticable is Ingolia, Brudzinski, Fitzpatrick and of Thad Allen to name a few.

Please send this information to Congressman Cummings as well as the Gulf Coast Mariners Association and the North Carolina Fishermens Association. Individuals in these two organizations have a passion to see this corrupt system elimanted. It will be well worth the few dollars in postage. I am from RI and I have forwarded anything that I believe documented bias in my case. I had the pleasure of being in front of Brudzinski. I thought I had a clear cut case. That's why I did not sign a settlement agreement. Guess how it turned out??????

You are absolutely right. I lost. I wasted my time and money on a lawyer. I should have just signed the plea agreement and been done with it. My real mistake was that I was relying on my principles. I was having a hard time getting myself to sign a plea agreement for something I didn't do. I guess I should have just signed it anway. It would have saved me a lot of money. I was also dupped into remembering something called the US Constitution that provides everyone the presumption of innocence and the right to a fair trial. I guess these were just words we are taught in school with no real meaning .... at least not in front of a Coast Guard ALJ.

It is in writing by the commandant himself that issues RE the Constitution are not considered as he DOES NOT make decisions on Constitutional issues My friend you have NO rights as guaranteed by the Constitution when a party to an S&R Hearing Held by a branch of the military that being The United States Coast Guard in a barrowed court room or as they prefer on THEIR USCG own property.A travesty to any Americam Citizen and we are expected to help feed the world?

Retired CG ALJ Peter J.Fitzpatrick was a stooge for Chief Judge Ingolia & USCG and is still a stooge For Ingolia & USCG as evidenced by his recent less than Truthful testimony to a congressional commitee of which Elija Cummings was a member.
Who asked Fitzpatrick to testify on the CG behalf? 2 guesses the first does not count!!Oh yes Fitzpatrick I remember very well Your #1 CG Witnes A Man Who You Described in Your Seemingly Rigged and Corrupt Courtroom as a man with the Highest Credentials a man who you described in a way that made him a God! YOUR MAN TURNED OUT TO BE A COMPLETE FRAUD DIDNT HE? Oh Yes Fitzpatrick, Remember You had Conversations re this issue And YOU "FORGOT" TO INCLUDE ME In Your Conversations With The Coast Guard REMEMBER? I remember at the hearing I was asking to many questions you were upset with me!! the IO Oneal was yelling at me!! it was getting late in the day and you decided to make this mariner spend more money and let the I/O cool down, you ended the hearing for the day to continue the following AM. I remember very well having 2 US Marshalls sitting almost in my lap for the Second Day of my Hearing !! Why Fitzpatrick? I remember the armed USCG cops that traveled for more than 8 hrs to my house just to tell me not to make any threats? Although they did not accuse me of anything. Oh yes I played a tape for them They asked for water as they hurridly wanted to leave 3 days latter I was told who ordered the hit Guess Who? The US Military Has No Business Suprentending Americam Civilian Citizens as we are stripped of our Constitutional rights to a Fair and speedy trial How can it be Fare? The Prosecutor and the ALJ are paid by the same party The ALJ and the Prosecutor both Answer to the Commandant How Could S&R Hearings not be rigged? as it is the Hearings rigged by default alone Time to say good bye to a very corrupt system at best

USCG Violates Costitution of civilain Citizen After Fitzpatricks Man Made God was proven a liar(Perjury at Hearing) and a fraud The Cg decided they had to win!! The Commandant ordered the ALJ Fitzpatrick to RETRY Me on the same charges Using a REPLACEMENT WITNES to replace the Liar and Fraud Problem again for the USCG New Star Witnes was TERMINATED by her employer for what I believe was her 7 documented violation of Company SOP Once again Fitzpatrick forgot the rules and took part in prohibited Ex Parte Communications with the CG. Fitzpatricks Right hand Lady quit Fitzpatrick said I was the cause of her quiting we know this statement by the ALJ was More BS. The CG has and continues to take a very adversarial stance to the mariners it suprentends Time for you to Go CG

I am a 40 year old commercial fisherman. I have has a lot of stress in my life....death of family and friends....an uninsured boat sinking.... crewmembers getting hurt, but I can honestly say that nothing has caused me more stress than witnessing first hand just how corrupt the current Coast Guard ALJ system really is. I had the pleasure of being in front of ALJ Brudzinski. I felt I has a strong case and passed on my chance to sign a plea bargain which would have reduced my fine to 50% if I admited guilt. I had a big problem with that because I was innocent of the charges. My pride would not let me volentarily sign an agreement admiting guilt for something I was not guilty of. Then I got a first hand lesson in the Coast Guard Judicial system. Commercial fishermen from RI call this system the "Kangaroo Court". The guilty verdict is already "in the pocket" before the hearing even starts. Our lawyers tell us it is in your best interst to sign a settlement agreement because you won't win. If your response is "yes but I am innocent" it just goes to show how niave you really are. Innocense doesn't matter the fact is you will lose. God Bless Elijah Cummings and ALJ Massey and Richard Block from Gulf Coast Mariners Association and Sean McKeon from North Carolina's Fishing Association and anyone else who was passionate enough to see the corruption in this system and vow to dismantle it. Contrary to Thad Allen, this system does need to be eliminated. Those who oppose the dismantling of this corrupt system obviously have to go too.(along with those who played an active role in this large scale obstruction of justice). Good ridence to such a CORRUPT SYSTEM that has inflicted immmeasurable damage on victims who were "ROBBED" at their chance to a fair trial or "EXTORTED" into signing a settlement agreement. There should really be no more talk about dismantling the system. It should be a DONE DEAL at this point. We need to focus our efforts at 2 remaining items (1) bringing those who participated in obstruction of justice to be held accountable for their actions and (2)remedy for the victims of this corrupt system

Alright, the Coast Guard ALJ system got caught red handed using a "two headed coin" in their judicial coin toss. I guess tha explains why the respondent got "tails". Now there are those like Thad Allen who have the balls to defy the intentions of Congress and attempt to defend this corrupt system. What is wrong withh you Mr. Allen? That ship of corruption is sinking. You may think it is a commendable act to stick up for the system that gives you your paycheck but give me a break man. Don't you have one morsel of honesty or integrity somewhere in yourself? I believe your actions are criminal in attempting to defend the current Coat Guard ALJ system. Your actions fit firmly into the category of "Obstruction of Justice". Those who are found guilty of this can serve long jail sentences. I am sure that your attempt to defend such a system was just just a "poor judgement call" that you are more than willing to reconsider? Right? I thought so.....

I was just reading on line about the 4.3 million dollar fine and removal from fishing forever for the Spalt brothers in 1997. This was the order of a US Coast Guard ALJ named Peter Fitzpatrick. Is this the same judge mentioned in Greg's post from AR? I wonder if the Spalt brothers think of the current facts that have emerged????? They got fined 4.3 million for allegedly not following the laws that apply to commercial fishermen. How much should those be fined who do not follow the laws that apply to the judicial system. How about 4.3 billion?????? Someone should tell the Spalt brothers that their right to a fair trial may have been truncated by ALJ Peter Fitzpatrick. Greg from AR, I bet the Spalt brothers would be interested in the information you posses.
