She's every bit as able to hear arguments in this case as are Scalia and Thomas, guests of a party given by the law firm arguing against the government in this case. Thomas is PARTICULARLY guilty of conflicts of interest, since his wife Ginni spent the last year or so working for the tea party group Liberty Central, which fought President Obama's health care reform law. She's an anti-Obamacare LOBBYIST, for chrissakes.

The polls also show that only 28% of the country supports overturning Roe v. Wade, but that doesn't deter the right wingnuts in the least. I would think the loony right would support everyone having health insurance, that would make Medicaid obsolete, and would drive insurance costs down having everyone in the pool. It would require a little thought from the right, which is sadly lacking as usual! The states can mandate auto insurance, why can't the feds require healthcare insurance to save billions in Medicaid payments? Sounds like a "no brainer" to me.

Not the same. Kagan was much more directly involved. But I would accept Thomas being out on this to be fair.

The fact that Thomases wife worked for a "tea party group", has nothing to do w how Thomas may see the case. HOWEVER the fact that the newest justice worked the big O during the ramrodding of this bill, the fact that as Solicitar Gen. it was her job to look at the law and see possible legal problems with it should disquaify her from the case. SHE had a vested interest in the bill, Thomas does not. Now I believe that IF Thomas saw a conflict, he would recuse himself. He proved himself to be a man of honor with the virginia military academy case. The question is will the newest SCJ be as honorable... doubt it

Problem with Oblundercare is, it doesn't GIVE anyone health insurance. It mandates a select few must PURCHASE insurance, as well as helping to pay for health coverage of dead-beats. Try taking your own advice and thinking for a change.

there will be a lot of comments as this makes it way thru the courts and even tho there are 9 taking the ride the big money is on a 4 - 4 tie on the final with one abstention or the court "does have an out" where they walk away from any ruling pro or con!! they can refuse "cert" and that closes the book!! as i see it right now they are digesting 5.5 hours of hearings only!!

Justice Kagan is a socialist that Obama added to the Supreme Court knowing that she will vote for the Obama care regardless if she supported the law before she was nominated. Clearly, Obama proved to be New world Order Regime that aim at converting America to become socialistic and under the new socialistic –Mozlem Brother rule. Will the American people stand up to denounce Kagan intent to support ruling for the Obama care which prove conflict of interests and a new low point of lies and corruption of the Supreme Court in US history.

What do you suppose Medicaid is? It gives tax payer health care to those that refuse the responsibility of providing for their own health care coverage. I'm damn tired of paying taxes for those that will not take care of themselves. Nobody should be given anything, and it is time for every American to pay their own freight. My beef with him is not only that he wouldn't support single-payer, but that he HIMSELF opposed this 'Massachusetts plan' to force people to buy insurance, then reversed himself after being elected.

Apparently you weren't smart enough to note that she's worked essentially as a lobbyist AGAINST Obamacare. That makes Thomas equally compromised and in need of recusal. If anything, Ginni Thomas (and therefore, her husband) have MORE of a financial interest in the bill, since Kagan is no longer in the administration but the Thomases are still profiting from arguing the case against.

Thomas is NOT a man of honor, and is even less a competent juror.

Sorry, but if you think Oblundercare means that you and I will no longer have to pay for the healthcare of dead-beats, you are mistaken, and obviously haven't read the bill.

Under Oblundercare, the tax payer will still be footing the bill for the poor. Additionally, the tax payer will also be footing a chunk of the insurance bill for businesses that provide health coverage for employees.

Thus, under Oblundercare, you will not only STILL be paying for the poor, but you will also be paying for those that can afford to buy their own.

If you notice, even the Dems who voted down ending collective bargaining in Ohio also voted down Obamacare. Obamacare places millions of people per state onto Medicaid, it guts Medicare so badly to fund Obamacare that it destroys Medicare to the point doctors are no longer taking people on Medicare, ERs are being shut down, doctors are quitting. I am on Medicare and my doctor quit and the hospital did not give me a new doctor for almost a year because they could not find one to hire. They cut back on many things, increased copayments, and starting next year, with the new cuts to doctor payments down to NOTHING, I bet I lose the new doctor I just got. Obamacare taxes us 1.5 trillion dollars with a host of new taxes, that money goes to people to buy health care. Obamacare exempts so many different groups of people that it cannot work anyway, it destroys Medicare, and it shoves so many millions of people onto Medicaid it will bankrupt the bankrupt states, and it will pay doctors so little for Medicaid patients that no doctors will take them. Obamacare is based on screwing doctors to death and they are not putting up with it, they are quitting. Why should anyone go into student loan debt and become a doctor and be told they can only charge $25 a visit so Obama can give everyone health care, when same person could have gone to law school instead of medical school and charge $1,500 an hour?? It is NOT going to work. It should come down 5-4 against Obamacare, and Obama wasted four years on this. This will make sure he is not reelected, IMO depending on who the Repubs put up. If they put up one of the nuts, Obama will win by default, but if Ron Paul gets some traction, he's polling number one in Iowa and has the ground game, super strong supporters, if he wins Iowa, he will take off, and if he goes up against Obama, Ron Paul will win for sure. He has no scandals, an excellent voting record, no flip flops, he's way smarter than Obama and can debate Obama with regards to Libertarian ideas. Even Romney will be able to beat Obama due to the Obamacare mess. Since the country was in high unemployment and an economic crisis, when Obama could not get single payer Medicare for all, he should have scraped his plan like Hilary did and moved on to other issues, IMO. Obamacare will go down in the Supreme Court and tank his reelection, IMO.

Exactly!!! This law Mandates the PURCHASE of INSURANCE.(Health care INSURANCE is NOT healthcare)

The MORE insurance a person can afford to purchase, the BETTER/MORE healthcare/test/therapy a doctor will be able to provide to you.

Everyone else who can barely afford or cannot afford INSURANCE, the LESS healthcare/test/therapy will be available.

The 'lesser' insured won't cover the 'top of the line' diagnostic tools, treatments, etc.

Plus there is NO GUARANTEE that anything will bring DOWN costs. Insurance is NOT CHEAP. Co-payments can add up quickly. Drugs can be COSTLY. Deductibles (the money you pay BEFORE insurance kicks in) can be horrifically expensive, if one wants to keep the monthly INSURANCE PREMIUM cost down.

Good luck with all this!!

After paying one's monthly housing costs, food costs, transportation costs, clothing costs, entertainment costs, REMEMBER to put something aside to cover the MONTHLY INSURANCE PREMIUM required to be paid to the Health INSURANCE INDUSTRY.

The health insurance industry has the GOVERNMENT IN THEIR POCKET !!
