California's Supreme Court struck down the state's ban on same-sex marriage in May 2008, ruling that the state's constitution gives "this basic civil right to (marry to) all Californians, whether gay or heterosexual, and to same-sex couples as well as to opposite-sex couples."

No, its not legal in 36 (not 37) states - tho many of those states DO allow domestic partnership, SSM is next.

And no, other states can ONLY not recognize the marriages of other states AS IT PERTAINS TO THE LAWS OF THAT STATE. Federally, its going to be recognized in all states - ie: federal taxes, federal employment, federal discrimination, insurance, survivorship etc...

1) After H8 passed, California supreme court affirmed the amendement in the state constitution. Gays filed lawsuit and case ended up before GAY Judge Vaughn Walker at District Court. Obviously (i.e. He's gay....conflict of interest) GAY Judge Walker said H8 was unconstitutionalby virtue of 14th Amendment. Those w/ legal standing to contest GAY Judge Walker's decision were social libturds (Gov. Schwarzenner, state attorney general) & supported his decision. Civilian proponents of H8 took matter to 9th Circuit Court of Appeals & then SCOTUS. SCOTUS found proponents lacked legal standing, & therefore GAY Judge Walker's ruling stands. SCOTUS DID NOT make a ruling on H8. You are wrong.

Sucks to be the 52% of Californians who opposed SSM in their state (47% supported SSM). Their collective voice...The Voice Of The People... was stripped from them by gays. Push back will be hell. Forcing your illicit lifestyle on society isn't welcome.

SCOTUS addressed Section 3 of DOMA only. It did NOT address section 2. Ergo, the question still stands as to what fed gov't will do if "married" gay couple moves to state that doesn't recognize SSM.
