You may be right. Making lists of write-in candidates available at polling places seems to defeat the purose of write-in candidacies. Also, I don't think that Alaskan law was followed regrading correct spelling of a candidate's name. Yes, it looks like the old corrupt Alaskan GOP machinery still has some kick left in it. OTOH, none of this changes the fact that Miller did not run a terribly great campaign.

The people had spoken after the GOP primary and Senator Murkowski had promised to honor the results. However, she chose to run as write-in candidate. That was her right, but on could claim that she wasted taxpayer money with added costs of printing the list of write-in names, and added costs of manual counting of write-in votes.
I think that Murkowski will prevail, and that even though she is one of the corrupt members of the old GOP in Alaska and lied about not running as write-in, I have some respect for her for her tenacity. In addition, the Senate seat was Miller's to lose and it looks like he managed to do so.
However, Miller has the right to exhaust his appeals and is no more of a tax water than Murkowski.

I wonder if the same decion would have been rendered if the write-in candidate had been a democrat?

I guess Joe could take it to the Supreme Court on appeal - like Bush did Gore.
