NH GOP Chair Sununu Says Marriage Equality is 'Garbage'

That is not the constitution but opinion of at least 5 SCJ. What your are talking about is not enumerated in the constitution. You are basing it on case law. Case law and specifically enumerated rights are not the same thing. Besides there is a lot of bad case law.

If the SCJ were historical grammarians I would be more inclined to agree with you.

You clearly do not understand constitutional law. The thousands of decisions made on constitutional challenges are also considered valid constitutional precedent. Some decisions, like dred scott, have been overturned and abandoned in favor of more enlightened verdicts as society evolves.
