Steven Stark, Chief Operating Officer of A New Horizon, a nonprofit credit counseling organization, says that many consumers turned to his company to avoid filing bankruptcy this year.

While the nation saw bankruptcy filings rise 9%, certain regions have experienced even higher numbers. In South Florida, bankruptcy filings were up by a staggering 40%. According to Stark, many clients seeking the help of his organization hail from states hit the hardest by the mortgage crisis, including Florida.“Our credit counseling and debt management programs help many consumers avoid bankruptcy, but it’s imperative that people seeking help do not delay or simply ignore paying their bills,” says Stark.

Other states hit especially hard include California and Arizona, where bankruptcy filings increased by 25% and 23.9%, respectively. Tennessee fared the best, with the rate of filings actually falling over 7%. The vast majority of bankruptcies filed in 2010 were Chapter 7 liquidations.

Stark noted that his organization expects the rate of personal bankruptcy filing to increase again in 2011 as the ripple effect of the mortgage crisis and prolonged high unemployment begin to affect new markets and demographics.“The best thing people facing insurmountable debt can do is get help early,” says Stark.

It’s Official: 2009 Sets New Default Record At 265

In case you needed more evidence that 2009 was a blockbuster year for bankruptcies, the total number of defaults for the year are out. And the news is grim.

Standard & Poor’s on Friday released its default tally for 2009. The ratings agency says the total hit 265, the highest since it began keeping track in 1981 and well above the 229 defaults racked up in the 2001 recession.

S&P said distressed exchanges, in which a company looks to ease its debt load by asking investors to swap their debt for new debt or equity, made up the largest share of the default tally at 103 followed by missed payments.

The news wasn’t all negative (or positive if you’re someone who makes a living off corporate failures). The default rate in the U.S. is expected to come down markedly from 10.9% to about 6.9% during the next year, S&P says. Also, the ratings agency counts 225 companies globally with combined rated debt of $214 billion that are most at risk for default. That’s down from the March 2009 peak of 300 companies with more than $500 billion in outstanding debt.

S&P’s projections seem to jive with bankruptcy experts who predict a slowdown in activity after a hectic 2009. Still, the new year has kicked off with a fresh batch of corporate struggles. The first week of 2010 saw three defaults: trucking company YRC Worldwide Inc., Regent Communications Inc., Gateway Casinos & Entertainment Inc. and United Site Services Inc.

As San Bernardino consumer bankruptcy lawyers, we were disappointed but not surprised to see the final tally of bankruptcy filing numbers for all of 2010. According to the American Bankruptcy Institute, consumer bankruptcy filings met predictions last year, with a total of 1.53 million filings. That's up nine percent from 2009, and it sets a new record for highest number of filings per year since the 2005 bankruptcy law changes took effect.


The past several years have broken that record repeatedly, but one expert told the Wall Street Journal Jan. 4 that this may be the last such year, since borrowing has decreased. This year's numbers were attributed to the same causes as previous years: high unemployment, tight credit and the housing downturn. But surveys suggest that a growing number of filers have middle-class incomes and college degrees.

Record Debt Drives Record Bankruptcy Filings in Illinois

High unemployment, credit card debt, and foreclosure to blame

Bankruptcy filings in northern cities and suburbs are skyrocketing, as large debts force Illinoisans to file for Chapter 7 and Chapter 13 protection in greater and greater numbers.

The first and second quarters of 2010 saw exponential growth in the number of consumer bankruptcy filings. There was a 29% increase in the number of Chapter 7 filings and a 16% increase in the number of Chapter 13 filings, compared to the first and second quarters of the previous year.

Central and Southern Illinois had fewer Chapter 13 filings over the past two years, and Southern Illinois individually had less filings overall, according to the American Bankruptcy Institute.

The nation as a whole saw an increase of 15% for all personal filings, highlighting the particularly worrisome numbers in Northern Illinois, including Chicago and the suburbs.

The increased amount of debt that consumers take on has made keeping homes during tough economic times more difficult, according to the Daily Herald.

In the past, someone who was laid off would seek bankruptcy protection and then promise to make monthly payments on their mortgage. But due to increased debt, consumers are having a tough time meeting any large financial obligations.

Personal Bankruptcies Hit a High and May Keep Rising

In the fourth-floor courtroom of the U.S. Bankruptcy Court of the Southern District of California, which serves San Diego and Imperial counties (pop. 3.4 million), Chief Judge Peter W. Bowie's docket is overflowing. Bowie has 77 Chapter 13 bankruptcies on his Tuesday calendar, one of which is the case of Juan Flores.

Flores, 55, is the owner and sole proprietor of a local business, Carpet Care 4 Less. Throughout 2007, he saw his income plummet along with the national economy. "My business dropped off by 50%," he says. As his client roster evaporated, Flores started drawing on credit cards and took out a second mortgage to the tune of $57,000 in order to stay afloat. In 2009, out of options and under threat of losing his home of 10 years, Flores filed for Chapter 13 bankruptcy — a reorganization filing under which consumers agree to a plan to make payments of past-due debts to creditors for a three- to five-year period. But now he is behind on his payments again, and Wells Fargo Bank wants to restart foreclosure proceedings.

In March, more individuals and businesses filed for bankruptcy than in any month since October 2005, when federal bankruptcy laws were made more restrictive. There were 158,141 U.S. bankruptcy petitions filed last month — a 35% increase over February's figure, according to data compiled by Automated Access to Court Records (AACER). This was a 19% increase over the number in October 2009, the last record-high month.

In the first quarter of 2010, the rate of personal bankruptcy filings in a dozen states increased by double-digit percentages over 2009's monthly averages.

"What is surprising is that there are still hefty increases in states like Arizona, California and Florida," says AACER president Mike Bickford, referring to the fact that it might seem that the worst would be over in states hard-hit by the housing bubble.

"Intuitively, you would think there might be some leveling off in these states, but that is not the case.

In addition, there were large increases in bankruptcy filings in the Midwest, especially Michigan and Illinois."

Michelle Obama's Patient-Dumping Scheme

The First Lady helped create a notorious program that dumped poor patients on community hospitals, yet the national media ignore the story. Imagine if her husband were a Republican.

The University of Chicago Medical Center has received a good deal of justly opprobrious press over its policy of "redirecting" low-income patients to community hospitals while reserving its own beds for well-heeled patients requiring highly profitable procedures. Substantial coverage was given to a recent indictment of the program by the American College of Emergency Physicians. ACEP's president, Dr. Nick Jouriles, released a statement suggesting that the initiative comes "dangerously close to ‘patient dumping,' a practice made illegal by the Emergency Medical Labor and Treatment Act, and reflected an effort to ‘cherry pick' wealthy patients over poor."

Oddly absent from most of the unflattering press coverage of UCMC's patient-dumping scheme is any mention of the role our new First Lady played in devising the program. A laudable exception has been the Chicago Sun-Times, which reported last August that "Michelle Obama -- currently on unpaid leave from her $317,000-a-year job as a vice president of the prestigious hospital -- helped create the program."

On the rare occasions when other "news" media have bothered to connect the Urban Health Initiative to its glamorous creator, they have attempted to whitewash this tawdry program. Typical of such disingenuous coverage was a story in the Washington Post, which described it as "an innovative program to steer the patients to existing neighborhood clinics."

But no amount of journalistic lipstick can hide the reality that Mrs. Obama's initiative is a patient-dumping scheme.
